RECORDED AT THE REQUEST OF <br />AND WHEN RECORDED RETURN TO: <br />Name: City Clerk <br />City of San Leandro <br />835 E. 14' Street <br />San Leandro, CA 94577 <br />APN: 077A-0647-015-00 <br />(Space Above Line for Recorder's Use Only) <br />GRANT OF EASEMENT <br />This GRANT OF EASEMENT (this "Easement") is made and entered into effective as of <br />September 17 , 2012 by Kaiser Foundation Hospitals, a California nonprofit public benefit <br />corporation ("Grantor"), for the benefit of the City of San Leandro, a municipal corporation <br />("Grantee"). <br />RECITALS <br />A. Grantor owns that certain real property situated in the City of San Leandro, <br />California, as more particularly described in Exhibit A attached hereto and incorporated herein <br />(the "Property"). <br />B. Grantor desires to provide for the establishment of a non-exclusive utility easement <br />for the installation, maintenance, and use of a traffic signal along with any other public utility <br />uses needed on the Property, upon the terms and conditions hereinafter set forth. <br />NOW, THEREFORE, for good and valuable consideration, the receipt of which is hereby <br />acknowledged, the parties agree as follows: <br />1. Grant of Easement. Subject to the terms and conditions hereinafter set forth, Grantor <br />hereby grants to Grantee a non-exclusive utility easement to install, maintain, and use the area on <br />the Property for utility purposes, as more particularly described in Exhibit A (the "Easement <br />Area"). <br />2. Term. This Easement shall continue in full force and effect in perpetuity from the <br />date of recordation of this Easement. <br />3. Public Utility Providers. Grantee shall have the right to make this Easement <br />available to any public utility provider, so long as each such public utility provide: (i) is a public <br />utility provider located within the county of the Property; (ii) provides a written request to <br />Grantor no later than sixty (60) days prior to its requested use of the Easement Area; and (iii) <br />files a notice in the real property records of the county in which the Property is located agreeing <br />to be bound by the terms and conditions of this Easement. <br />1875305.1 <br />1941979.2 <br />
