1 <br />2 <br />3 <br />4 <br />5 <br />6 <br />7 <br />8 <br />9 <br />10 <br />11 <br />12 <br />13 <br />14 <br />15 <br />16 <br />17 <br />18 <br />19 <br />20 <br />21 <br />22 <br />23 <br />24 <br />25 <br />26 <br />27 <br />28 <br />11 • • <br />WHEREAS, on February 2, 2009, the City of San Leandro (the "City") filed a <br />Complaint in Eminent Domain to acquire a portion in and to Assessor's Parcel number <br />077A-0649-008-22, specifically fee simple title, any and all rights, title and interest, in and <br />to a portion of the subject property located at 2550 Davis Street, San Leandro, County of <br />Alameda, California, for the City's Water Pollution Control Plant Expansion Project (the <br />"Project"); <br />IT APPEARING, and the Court finds, that Judgment in Condemnation having been <br />entered in the above entitled action on November 4, 2010, with the Amended Judgment <br />having been filed on March 8, 2011, in the office of the Clerk of the Alameda County <br />Superior Court, State of California; that Judgment having ordered, adjudged and decreed <br />that Plaintiff City is entitled to take by condemnation the property described therein and <br />more particularly described in Exhibit "A° and depicted in Exhibit "B," attached hereto and <br />incorporated herein by this reference, and that plaintiff City has paid to defendants the sun <br />of money assessed by the Judgment in Condemnation entered herein [$1,650,000.00 to <br />defendants JOHN BLASQUEZ and DOLORES BLASQUEZ, TRUSTEES UNDER THE <br />JOHN AND DOLORES BLASQUEZ REVOCABLE INTERVIVOS TRUST DATED MARCH <br />7, 1984 (real property owners) (pursuant to the parties Settlement Agreement dated <br />September 22, 2010), and $283,695.00 (fair market value of the inventory and furniture, <br />fixtures and equipment) plus interest due in the amount of $2,935.19 through October 22, <br />2010, and per diem interest each day thereafter in the sum of $4.39 until the date the <br />balance of judgment is paid into court, and costs as allowed by law, to defendants JORGE <br />MERCADO, JESUS MARQUEZ AND JESUS PADILLIA DBA BERT AND JOHNNIE'S <br />AUTO PARTS AND JESUS PADILLA] as full and just compensation for the taking of said <br />property; <br />1 <br />Final Order In Condemnation — Action in Eminent Domain <br />
