WX66050 <br />R F : 50` 1 . <br />yard fence removed to facilitate construction with a solid redwood fence <br />six feet (6') high, and of sufficient length to replace the damaged por- <br />tion, not less than twenty feet (20') in length. <br />3. Replace any trees or shrubs which die within a period of twelve <br />(12) months from the effective date of this grant as a direct and proximate <br />result of the sewer construction, with a like or similar kind, or to make <br />restitution to the Grantors in an amount determined by mutual agreement of <br />the Grantors and the Superintendent of Parks of City. <br />4. Restore the existing structures and ground conditions affected <br />by the construction to a state of good repair upon completion of the work. <br />5. Abandon, upon completion of the sewer within the easement granted <br />hereby, the presently existing sewer line in place, block the existing <br />line, fill the existing manholes, and abandon the presently existing sewer <br />easement within the boundary of Grantors' property. <br />This easement shall run with the land herein described to the benefit <br />of the parties hereto, and shall bind both parties hereto, their heirs, <br />administrators, executors, successors and assigns. <br />In Witness Whereof, City has hereunto caused its name and corporate <br />seal to be affixed by its Mayor thereunto duly authorized, and Grantors <br />have signed their names hereto the day and year hereinafter set forth. <br />Dated: April 5, 1965 at San Leandro, California. <br />CITY OF SAN LEANDRO, a municipal <br />corporation <br />By <br />J C14 <br />k D.
