5. After due consideration of all oral and documentary evidence <br />introduced and upon official notice of the plans, specifications, reports, <br />(negative declaration) heretofore prepared or adopted; <br />NOW, THEREFORE, the City Council of the City of San Leandro does RESOLVE <br />as follows: <br />(a) The subject property is taken for public use as <br />public right-of-way for street, highway and other <br />purposes and pursuant to the authority granted in <br />Streets and Highways Code §4090, Government Code <br />§40404, Title 7, Part 3 of the Code of Civil Pro- <br />cedure, Article 11, §5 of the California Constitu- <br />tion and the Charter of the City of San Leandro. <br />(b) The property taken pursuant to this exercise of <br />the power of eminent domain is generally described <br />as Parcal A of Parcel 79A-475-7-9, Parcel B of <br />Parcel 79A-475-7-9, Parcel C of Parcel 79A-51-5-2-•8 <br />and is located in the City of San Leandro.
