STREET DEDICATION
<br />THIS INDENTURE, made and entered into this 12th day of November, 1953,
<br />by and between HALSEY E. DUNNIGAN and MARTHA L. DUNNIGAN, his wife,
<br />the parties cf' the first part, and the
<br />CITY OF SAN LEANDRO, a municipal corporation, situated in the County
<br />of Alameda, State of California, the party of the second part.
<br />WITNESSETH: That the said parties of the first part, do hereby grant,
<br />transfer and alien unto the said party of the second part for the pur-
<br />pose of a public street or highway, all that certain parcel of land
<br />situated in the City of San Leandro, County of Alameda, State of
<br />California, described as follows:
<br />A portion of that certain parcel of land described in Deed from
<br />Mary Ethelyn Howe, a widow, to Halsey E. Dunnigan and Martha L. Dunnigan,
<br />his wife, dated July 25, 1951 and recorded July 27, 1951 under Recorder's
<br />Series No. AF/63477 in Bock 6497 of Official Records of Alameda County,
<br />page 21b; and also
<br />A portion of that certain parcel of land described in Deed from
<br />Garland B. Moore and Mary F. Moore, his wife, to Halsey E. Dunnigan and
<br />Martha L. Dunnigan, his wife, dated January 31, 1944 and recorded
<br />February 11, 1944 under Recorder's Series No. RR/8345 in Bo-k 4499 of
<br />Official Records of Alameda County, page 101, bounded as follows:
<br />Beginning at the point of intersection of the western line of Lot 6 with
<br />the northern line of Karol Nay, as said lot and way are shown on the map
<br />of "Tract 1129", filed June 1, 1953 in Book 33 of Maps, page b3, in the
<br />office of the County Recorder of Alameda County; running thence along
<br />the western line of said Karol ;uay south d`' 15' east 50.00 feet to a
<br />point on the southern line of said Karol Way; thence westerly along the
<br />are of a curve to the right with a radius of 100.00 feet, from a tangent
<br />which bears south 81" i51 west a distance o{' 40.58 feet; thence north
<br />75� 00' west tangent to the said last mentioned arc, a distance of 69.00
<br />feet to a point on a line drawn parallel with the western boundary line
<br />of the said parcel of land described in Deed from Garland B. Moore and
<br />Mary F. Moore, his wife, and distant 1.32 feet easterly therefrom,
<br />measured at right angles thereto; thence along the said parallel line so
<br />drawn north d° 141 west 54.41 feet; thence Duth 750 00' east 90.47 feet;
<br />thence easterly along the are of a curve to the left with a radius of
<br />50.00 feet, tangent to the said last mentioned course, 20.29 feet to the
<br />point of beginning.
<br />The property hereby conveyed to be known as Karol Way until such time as
<br />the party of the second part deems it necessary to designate it otherwise.
<br />TO HAVE AND TO HOLD unto the said party of the second part forever, for
<br />the sole object and purpose of maintaining therein a public street or
<br />highway and for no other purpose; and should said real property herein
<br />described be at any time used for any other purpose by said party of the
<br />second part than for the purpose herein mentioned, then this grant shall
<br />immediately lapse and become null and void and said grant shall immediately
<br />revert to said parties of the first part, their successors and assigns.
<br />IN WITNESS WHEREOF, the said parties of the first part have executed this
<br />instrument the day, month and year first above written.
