1 3.) To credit CITY with the lump sum amount of $300, which <br />2 figure represents one-third (1/3) of the cost to CITY for the <br />3 installation of electrical conduit at the intersection of STATE's <br />4 revised westbound Hesperian Boulevard off -ramp and the new CITY <br />5 Street (Springlake Drive), which STATE would have expended for the <br />6 installation of electrical conduit had this improvement been <br />7 installed by STATE's contractor. <br />8 4.) To maintain and operate the entire traffic control <br />9 signal system and safety lighting as installed and to perform II <br />10 such other maintenance as required pursuant to provisions of <br />11 Section IV of this Agreement. <br />12 5.) To furnish CITY, upon completion and acceptance by STATE:• <br />i <br />13 of STATE's construction contract for improvements referred to herein, <br />14 a detailed statement of costs to be borne by CITY and to refund to <br />15 CITY any amount of CITY's advance deposit, provided for hereinaftezt <br />16 in Section II, Article (1), remaining after actual costs to be borne <br />I <br />17 by CITY have been deducted. <br />18 <br />6.) Upon presentation by CITY, to accept conveyance from i <br />19 CITY of all rights of way (fee title) held by CITY in and to those <br />20 areas acquired by CITY to accommodate construction of said I <br />I <br />21 improvements and to all rights of way (fee title) adjacent to and <br />22 north of Route 238 for the future revision of the Routes 17/238 i <br />23 Interchange, all as shown in red on attached Exhibit "A". <br />24 7.) To make all necessary arrangements with the owner or <br />25 � <br />owners of public or private utilities for the removal and/or ! <br />i <br />26 relocation of all utilities which could conflict with the aforesai4 <br />27 construction, in accordance with applicable laws or Master <br />-3- <br />
