e <br />:!Said Exhibit "A" is attached hereto to generally define the areas <br />through which rights of way are to be acquired and improvements <br />constructed and is subordinate to details to be shown on final <br />i j appraisal or right of way record maps and final construction plans, <br />• n which plans shall be conclusive as the scope of work to be <br />accomplished hereunder. <br />SECTION IV <br />IT IS MUTUALLY UNDERSTOOD AND AGREED that maintenance of any <br />improvements constructed pursuant to this Agreement which lie <br />outside STATE's highway right of way will be maintained by CITY <br />at the sole expense of CITY, and that, except for maintenance of <br />the aforesaid traffic control signal system and safety lighting, <br />maintenance of all other improvements constructed pursuant to this <br />� Agreement which lie within STATE's highway right of way will be <br />maintained and the cost thereof borne by the responsible agency in <br />accordance with that certain Agreement for Maintenance of STATE <br />Highways within the CITY which is in effect, executed by CITY on <br />' December 21, 1970, and by STATE on January 12, 1971, and/or <br />,1 subsequent modification thereto., <br />SECTION V <br />IT IS MUTUALLY UNDERSTOOD AND AGREED that ownership of the <br />existing signal system at the Route 238 westbound off -ramp <br />connection to Hesperian Boulevard shall be retained by CITY and <br />will be relocated by CITY, at CITY's sole expense, to the new <br />Intersection of Springlake Drive with Hesperian Boulevard upon <br />completion of the new off -ramp connection to said Springlake <br />Drive. <br />-9- <br />
