72-75495 <br />Duplicate Original <br />AGREEMENT <br />3E:31541M:599 �/0 <br />THIS AGREEMENT, entered into this 5th day <br />of June , 1972, by and between the CITY OF SA.N <br />LEANDRO, a municipal corporation ("CITY") , and MARC H. <br />MONHEIMER and BRUCE M. COWAN, as Trustees of the B/K/San <br />Leandro Trust ("OWNER"). <br />Dania- =lc <br />OWNER desires to convey to CITY the real <br />property described in "Exhibit A" attached hereto and <br />by this reference incorporated herein (the "Property"). <br />CITY desires to acquire the Property without <br />obligation for the costs or other expenses in connection <br />with the improvement thereof. <br />NOW THEREFORE, it is hereby agreed as follows: <br />1. OWNER agrees forthwith to convey the <br />property to the CITY, in fee, subject to all easements, <br />restrictions, rights and reservations of record shown <br />in OWNER'S policy of title insurance, a copy of which is <br />attached hereto as "Exhibit B" and by this reference in- <br />corporated herein. OWNER warrants and represents that <br />at the date hereof and at the date of recordation hereof <br />title to the Property is and shall be free and clear of <br />all matters of record except liens for current real prop - <br />PI -I m <br />erty taxes not delinquent and Exceptions 1 and 24set <br />forth in said policy of title insurance. <br />
