EAST BAY MUNICIPAL UTILITY DISTRICT
June 28, 1979
Mr. P. H. Long
Public Works Director
City of San Leandro
835 East 14th Street
San Leandro, CA 94577
r
y _
L o t7CD
,.,I', , . IIRY
Subject: Vacation of Portion of West
Estudillo Avenue
Dear Mr. Long:
Your letter of June 22, 1979, to Mr. D. G. Larkin has been re-
viewed with our Legal Department. They advise that we are not
responsible for relocating our facilities at our expense in that
portion of West Estudillo Avenue for which you have initiated
abandonment proceedings.
We will, therefore, be filing a Notice of Easement pursuant to
Section 812.5 of the Civil Code because we must continue to main-
tain the 12-inch water main in West Estudillo Avenue which is an
essential part of our distribution system. .
Also, we have been unable to complete plans for the relocation of
our facilities as contemplated in our August 29, 1977, agreement
with the City because the City has not furnished us definitive
plans of the proposed downtown redevelopment project. On April
26, 1979, Messrs. Walter Ramos and John McBride from the District
met with Mr. William Rugg of the Redevelopment Agency to discuss
the availability of such plans and learned that they were still
not available at that time.
If you wish to meet and discuss this matter further, please give
me a call.
Very truly yours,
RECEIVED
JUN 2 9 1979
PUBLIC WORKS DEPT.
t°d Ot 1 SKnGGS
