ANY ADVERSE CLAIM BASED UPON THE ASSERTION THAT ANY PORTION OF <br />SAID LAND WAS NOT TIDE LAND SUBJECT TO DISPOSITION BY THE STATE OF <br />CALIFORNIA, OR THAT ANY PORTION THEREOF HAS CEASED TO BE TIDE LANDS <br />BY REASON OF EROSION OR BY REASON OF HAVING BECOME UPLAND BY <br />ACCRETION" <br />2v ANY ADVERSE CLAIM BASED UPON THE ASSERTION THAT ANY PORTION OF <br />SAID LAND WAS EXCLUDED FROM SALE BY THE STATE OF CALIFORNIA BY <br />REASON OF THE PROXIMITY THEREOF TO THE CITY OF SAN FRANCISCO OR <br />THE CITY AND COUNTY OF SAN FRANCISCO UNDER THE PROVISIONS OF THE <br />VARIOUS ACTS PROVIDING FOR THE SALE OF SUCH LANDS OR BASED UPON <br />THE ASSERTION THAT ANY PORTION OF SAID LAND DISPOSED OF AS SWAMP <br />AND OVERFLOWED LANDS WAS COVERED BY NAVIGABLE WATERS AT THE DATE <br />OF DISPOSITION BY THE STATE OF CALIFORNIA. <br />3. RIGHTS AND EASEMENTS FOR COMMERCE,, NAVIGATION AND FISHERY. <br />4. TERMS, PROVISIONS AND RESERVATIONS, CONTAINED IN THE SUBMERGED <br />LANDS ACT OF MAY 22, 1953, CH. 65 (67 STAT. 29, 43 U.S.C.A. 1301). <br />5. ANY ADVERSE CLAIM BASED UPON THE ASSERTION THAT ANY PORTION OF <br />THE LAND DESCRIBED IN DEED FROM THE STATE OF CALIFORNIA, RECORDED <br />FEBRUARY 17, 19320 IN BOOK 2788, PAGE 39 OFFICIAL RECORDS WAS <br />TIDE OR SUBMERGED LANDS AND SAID CONVEYANCE WAS A VIOLATION OF THE <br />PROVISIONS OF ARTICLE XV, SECTION 3 OF THE CONSTITUTION OF THE <br />STATE OF CALIFORNIA. <br />AFFECTS CERTAIN WESTERN PORTIONS OF PARCEL 2 OF PREMISES. <br />6. ANY ADVERSE CLAIM BASED UPON THE ASSERTION THAT ANY PORTION OF <br />SAID LAND WAS NOT TIDE LAND SUBJECT TO DISPOSITION BY THE STATE OF <br />CALIFORNIA, OR THAT ANY PORTION THEREOF HAS CEASED TO BE TIDE LANDS <br />BY REASON OF EROSION. <br />AFFECTS WESTERN PORTIONS OF PARCEL 1-A AND PARCEL 1-B OF PREMISES, <br />7. AN EASEMENT OVER A STRIP OF LAND 20 FEET WIDE, WITH SUFFICIENT <br />GROUND ON EACH SIDE TO RAISE IT AT LEAST 2 FEET OVER A STRIP OF <br />LAND RUNNING FROM A POINT ON THE ROAD LEADING FROM ROBERTS LANDING <br />TO HAYWARD, IMMEDIATELY WEST OF THE WESTERLY FENCE OF THE SOUTHERN <br />PACIFIC RAILROAD COMPANY ALONG THE WESTERLY LINE OF SAID FENCE TO <br />A POINT NORTH OF THE HOUSE OF WM, WHITNEY AND RUNNING THENCE SOUTH <br />IN A CURVED LINE BETWEEN SAID HOUSE AND FENCE TO LAND OF WM, WHITNEY <br />AT OR NEAR THE NORTHEAST CORNER THEREOF, AS SET FORTH IN THE FOLLOWING <br />DEEDS <br />-2- <br />
