Final passage must await signing of the cost -sharing agreement <br />between the Cit-Y and Caterpillar. <br />A copy .of the proposed agreement is -being returned herewith for <br />the certain changes needed to satisfy the City, none of which seems to <br />substantially affect our original intentions. They are as follows: <br />/ Paragraph 11 Since gas and water lines are still in Alvarado <br />Street and will be for an indefinite time, the rights of Pacific Gas & <br />Electric Co. and the East Bay Municipal Utility District must be added. <br />Paragraph 2. Include an additional item after Item (d), <br />"Adjust, repair or rehabilitate railroad spur crossing." <br />Paragraphs 5 and 8: We expect our engineering costs to run <br />somewhere between 10 and 15% so as we compromised over the prone, <br />please change these figures to 12% and 112% respectively. <br />Sheet 1 of Exhibit A: The portion of right of way to be granted <br />at the corner of Martinez and Antonio is not exactly like it is shown <br />on the drawing and has been modified as you requested to be at least <br />to clear of the building foundation. The enact detail of this parcel, <br />which as shown will clear the building by about 111, is shown on our <br />Drawing 547, Case 1602. I have included a sepia copy of the drawing <br />in case you wish to make it a part of your exhibit and save some <br />detailed drafting. <br />,t <br />
