t <br />CATERPILLAR TRACTOR CO <br />March 30, 1972 <br />City of San Leandro <br />San_ Leandro, California <br />Gentlemen: <br />During the course of negotiations between Caterpillar Tractor Co. and <br />the City of San Leandro waich re3ulted in a cost -sharing agreement for <br />improvements to portions of 11artinez and Antonio Streets, certain <br />understandings were reached which, pri-marily because t7hey related to <br />actions -that Light or will occur at sore future tire, were not proper <br />for inclusion in tie cost -sharing aLree ent. 1:e believe, however, <br />these understandings should be stated in writing. 'rhay are: <br />1. Vacation of a ;portion of Alvarado Street. If Caterpillar <br />Tractor Co. acquires the property abutting, the west side of <br />Alvarado Street between Davis and !.ntonio�Streeto it does <br />not presently own, the City will underta_.e all proceedins <br />necessary to vacate that portion of Alvarado Street between <br />Davis and Antonio Streets it has not previouUly vacated, <br />without charge to Caterpillar Tractor Co. <br />2. Sanitary sewer in Alvarado Street. Instead of reconstructing <br />the existing sanitary sewer in Alvarado Street between Davis <br />and Antonio Streets, t:.e City will construct, within a <br />reasonable period of time, a replacement sanitary sewer in <br />a different location, mutually satisfactory to Caterpillar <br />Tractor Co. and the City. Caterpillar Tractor Co. will pay <br />to the City an amount representing the difference between <br />(a) the cost of constructing the relocated replacement <br />sanitary sewer, and (b) the estimated cost of rebuilLinry <br />the sanitary sewer in its present location. The estimated <br />cost referred to in (b) shall 'we determined at the time the <br />contract for the work referred to in (a) is awarded. U-1hen <br />the replacement sanitary sewer is placed in service, the <br />City Will tact appropriate action to transfer its right, <br />title and interest in the existing sanitary sa:rer in <br />Alvarado Street between Davis and Antonio Streets to <br />Caterpillar Tractor Co. urithout charge. <br />3. Storm sewer in Antonio Straet. Upon cotoletion of a county <br />flood cotitrol project, desY,uates p-IS-1, t.:e City will have <br />no further need for the storm serer locate<i in Alvarado Street <br />between Davis and tntonio Streets.
