July lo, 1962 <br />CITY ENGINEERrS REPORT <br />ON <br />VACATION CF MARTELL COURT <br />1. Martell Court, a cul-de-sac, was dedicated to the <br />City of San Leandro, at the time of the development <br />of Tract 1919. Six lots front on the cul-de-sac, <br />none of which have been improved by building. <br />2. Sewers, water, gas and electrical facilities were <br />constructed within the right-of-way during original <br />construction of the tract. <br />3. The serving utility companies have indicated they <br />would not object to the abandonment of Martell Court, <br />provided easements were granted, Which would permit <br />them the right at any time to construct, maintain, <br />operate, replace, remove) renew and enlarge their <br />facilities and further allow, access to protect their <br />property. <br />4, The serving utility companies have also indicated <br />that if their facilities are to be removed at ary <br />time, now or in the future, that the cost of said <br />removal or relocation will be borne by the property <br />owner. <br />5. Now, therefore, as there appears to be no objection <br />to the proposed abandonment, it is recommended that <br />Martell. Court be vacated on the following conditions: <br />a. Existing utilities remain in place and that <br />easements therefor be reserved. <br />b. Property owner assume responsibility for con- <br />structing curb, gutter and sidewalk on the <br />west side of Harold Ave. across the vacated <br />Martell Court, if required. <br />c. Property owner agrees to bear the cost of <br />removing, extending or modifying the existing <br />utilities as required to conform to the ulti- <br />mate use of the adjacent property. <br />G.
