c224 TITLE V STREETS AND PARKS Chapter aal Street and Easement Abandonment reserve and except from the vacation the permanent easement and right at any time, or from time to time, to construct, maintain, operate, re- place, remove, and renew sanitary sewers and storm drains and appurte- nant structures in, upon, over and across any street or part thereof proposed to be vacated and pursuant to any existing franchises or re- newals thereof, or otherwise, to construct, maintain, operate, replace, remove, renew and enlarge lines of pipe, conduits, cables, wires, poles, and other convenient structures, equipment and fixtures for the operation of gas pipe lines, telegraphic and telephone lines, railroad lines, and for the transportation or distribution of electric energy, petroleum and its products, ammonia, water, and incidental purposes, Including access and the right to keep the property free from inflam- mable materials, and wood growth, and otherwise protect the same from all hazards in, upon and over the street or part thereof proposed to be vacated. Section 5-ao1-109a Resolution of Intention. Recital of Reserva- tions. In any proceedings for the vacation of any street or part thereof wherein the City Council may determine that the public con- venience and necessity require the reservation of easements and rights of way for structures in Section 5-ao1-108, such determination shall be recited in the resolution of intention in addition to any other matter required to be recited therein. Said resolution of intention shall also recite that the proceedings are taken subject to such res- ervations and exceptions. All subsequent proceedings of the City in relation to the vacation, including any deed or conveyance, if any, to the owners of the land underlying such street or part thereof, shall be subject to and governed by the reservations and exceptions contained in the resolution of Intention. Section 5-ae1-110o The authority granted and the procedure pro- vided by this Chapter is an alternative to any other authority or procedure provided by law.
