c224 <br />TITLE V STREETS AND PARKS <br />Chapter aal Street and Easement Abandonment <br />reserve and except from the vacation the permanent easement and right <br />at any time, or from time to time, to construct, maintain, operate, re- <br />place, remove, and renew sanitary sewers and storm drains and appurte- <br />nant structures in, upon, over and across any street or part thereof <br />proposed to be vacated and pursuant to any existing franchises or re- <br />newals thereof, or otherwise, to construct, maintain, operate, replace, <br />remove, renew and enlarge lines of pipe, conduits, cables, wires, <br />poles, and other convenient structures, equipment and fixtures for the <br />operation of gas pipe lines, telegraphic and telephone lines, railroad <br />lines, and for the transportation or distribution of electric energy, <br />petroleum and its products, ammonia, water, and incidental purposes, <br />Including access and the right to keep the property free from inflam- <br />mable materials, and wood growth, and otherwise protect the same from <br />all hazards in, upon and over the street or part thereof proposed to <br />be vacated. <br />Section 5-ao1-109a Resolution of Intention. Recital of Reserva- <br />tions. In any proceedings for the vacation of any street or part <br />thereof wherein the City Council may determine that the public con- <br />venience and necessity require the reservation of easements and rights <br />of way for structures in Section 5-ao1-108, such determination shall <br />be recited in the resolution of intention in addition to any other <br />matter required to be recited therein. Said resolution of intention <br />shall also recite that the proceedings are taken subject to such res- <br />ervations and exceptions. All subsequent proceedings of the City in <br />relation to the vacation, including any deed or conveyance, if any, <br />to the owners of the land underlying such street or part thereof, <br />shall be subject to and governed by the reservations and exceptions <br />contained in the resolution of Intention. <br />Section 5-ae1-110o The authority granted and the procedure pro- <br />vided by this Chapter is an alternative to any other authority or <br />procedure provided by law. <br />
