Page 1 of 2 <br />CITY ENGINEER'S REPORT ON <br />VACATION OF 135TH AVENUE <br />WEST OF ROSE DRIVE <br />1. The following plan and legal description are incorporated as part <br />of this report: <br />Drawing Number 489, Case 1603 <br />Description LD 72-50 <br />2. The affected street is shown as a dedicated public street on <br />"Tract 900," filed December 1, 1948, in Map Book 29 at pages 72 <br />and 73, Alameda County Records. The street is shown on said map <br />as "Pestana Avenue." <br />3. The subject abandonment will not deprive property owners access <br />to a public street, as witnessed by the attached letter from <br />applicant's attorney. <br />4. The serving utilities were notified of the proposed abandonment <br />and all replied they had no objection to the abandonment provided <br />that easements be reserved for gas, water and sanitary sewer <br />facilities. <br />5. I recommend that the City reserve the entire area of the vacation <br />as a "Public Utility Easement" for all purposes set forth in Sections <br />5-a.1-108 of the San Leandro Municipal Code of 1957, until such time <br />as this easement is no longer necessary. <br />6. I recommend that applicant be required to remove existing paving, <br />curb, gutter and sidewalk and to construct new curb, gutter and <br />sidewalk (and standard driveway if applicable) on the west side of <br />Rose Drive across 135th Avenue, and to construct new street paving <br />as required to conform. <br />
