01 <br />Y ATTORNEY'S OFFICE <br />�Cl 1 1977 <br />CITY OF SAN LEANDRO <br />I have had discussions with Frank Krause,Tax Collector, and Mr. Strong <br />of the Assessor's Office, and it appears that there must be some legal steps <br />taken in order to get certain property we have vacated back on the tax <br />roll and chargeable to those who are using the vacated areas. <br />Mr. Strong indicated that the City of Oakland has a pretty good procedure <br />whereby the City Manager is directed to execute a quitclaim deed, and the City <br />Clerk to record the same, as -a part of the vacation. When this is received <br />at the County, they had something substantial on which they can charge taxes. <br />I checked with Ms. Wampert of the Public Works Dept., City of Oakland, <br />and she tells me that anyone requesting an abandonment or vacation is required <br />to provide and pay for a title search. This then shows whether the City <br />owns the property in fee or whether it has been dedicated for street purposes <br />and will revert back to someone else (original subdivider, etc.) if vacated. <br />The petitioner must then contact whoever owns the property (if not the City) <br />and obtains a written agreement to the transfer if the vacation takes place. <br />Presumably if more than one person will get a quitclaim deed, someone must <br />have descriptions written by a licensed engineer, so it can be included in <br />the deeds. <br />Ms. Wampert is going to send a copy of their ordinance and quitclaim <br />deed form sometime this week. <br />If we go into something like this, I would carry this one step further <br />and require that the quitclaim deed be recorded within ten (10) days after <br />execution. <br />In order to take care of the four or five parcels which still show as <br />City }?roperty on the County Assessor's Block Books, I would write a letter <br />to the present owner or person using the property and notify them that the <br />property has not been properly "exchanged" and in order to protect their <br />interest, they should provide us with whatever information we need and we intend <br />to file a quitclaim deed and no doubt the Assessor will be increasing their taxes <br />as a result. <br />
