DRAFT <br />City Council <br />City of San Leandro <br />Subject: Master Plan Right of Way Requirements <br />Dick's Family Restaurant <br />Alvarado and Fremont <br />Gentlemen: <br />According to the Master Plan of City Streets, Fremont Avenue is designated as <br />a Type I Arterial and as such, its present right of way of 60' should be widened <br />to 80' and the curb -to -cub width should be widened to 64'. <br />Mr. Porter, operator of Dick's Restaurant, who leases a portion of the affected <br />property, is proposing to expand his lease and open a banquet room immediately <br />adjacent to the present restaurant. The banquet room will have a seating <br />capacity of approximately 150 people, with its own kitchen and toilet facilities. <br />A furniture company formerly occupied this area so obviously additional traffic <br />will be generated if the banquet room is at all successful. <br />Since an increase in traffic will be generated on the streets upon which this <br />property abuts, Chapter 17 of Title VII of the City Code requires the owner of <br />the property to grant and improve the additional right of way needed to accommodate <br />the Master Street Plan objectives. However, as provided under Article 3 of this <br />chapter, when the City Engineer determines that the owner would be required to <br />grant and make improvements to a greater extent than is reasonably related to <br />increased traffic or other needs, he shall recommend to the City Council that <br />the developer's obligation be reduced accordingly. <br />
