Hayes <br />Bigge Drayage C o . <br />10700 Bigge Avenue <br />-- -man Leandro, California — - - - - - <br />Dear Mr. Hayes: <br />Reference is made to your August 26, 1959, petition <br />to the City Council requesting annexation to the City of Oakland <br />of a certain parcel of land described in your petition. I sub- <br />sequently discussed with you the matter of an agreement by your <br />company and Morris Draying Company subjecting this annexed <br />property to tax liability for indebtedness of the City of Oakland <br />existing at the time of the annexation. In other words, this <br />property and other property in the City of Oakland would be <br />equally liable each in its own proportionate share for the tax <br />liability of the City of Oakland. Without this consent the City <br />of Oakland would not be able to assess against this parcel <br />property any taxes for pre-existing indebtedness such as pre- <br />viously contracted bonding liabilities. I explained to you that <br />the common accepted practice is for petitioners for annexation <br />to consent to such liability. You agreed that you would do so <br />In this instance. <br />Accordingly, enclosed is original and three copies of <br />- - - -- such a consent. Kindly have the original and one copy executed <br />by an authorized officer of your company and of Dorris Draying <br />Company and return them to us. The other copies are for your <br />respective files. You will note that the agreement provides for <br />specific title of the officer who executes the agreement and for <br />the affixing of the co4Drate seal of each company to the agreement. <br />A copy of this communication is going to your attorneys <br />for their information. <br />Very truly yours, <br />J4HN W.
