RAZETO, CHAIRMAN <br />On August 61 1956, proponents of a proposal to incorporate a City of the 6th <br />Class filed with the Board of Supervisors a notice of intention to circulate a petition, <br />pursuant to Section 34302.5 of the Government Code. The effect of filing such notice is .o <br />prohibit the legislative body of any city instituting proceedings for the annexation of u~Iy <br />territory described by such notice for a period of 50 days after the date of filing of such <br />notice. <br />Thereafter, the City of San Leandro filed with the Alameda County Boundary Commis- <br />sion a proposal to annex a portion of East 14th Street. Since this proposal overlapped upon <br />the territory described in the "Notice of Intention to Circulate Petition" referred to in <br />the first paragraph, our Boundary Commission Report and Recommendation No. 459, dated Septem- <br />ber 13, 1956, called attention to this fact. The 50-day period referred to in the first <br />paragraph expired at midnight on September 25, 1956. <br />Subsequent thereto, a new notice of intention to circulate a petition for incor- <br />poration of a 6th Class City was filed with our Board of Supervisors at 8:30 a.m. on Septem- <br />ber 26, 1956, describing the same territory as the former notice and including the portion <br />of East 14th Street which the City of San Leandro proposes to annex. <br />Our Board of Supervisors has requested that I ascertain from you whether the City <br />of San Leandro claims to have obtained jurisdiction between midnight September 25, 1956 <br />and 8:30 a.m. September 26, 1956 of proceedings to annex the portion within East 14th Street, <br />and if so, in what manner. <br />Yours very truly, <br />JACK G.
