4.. <br />GRANT OF EASEMENT <br />This Indenture made this day of f 19730 <br />between JERAS CORPORATION, a corporation, party of the first part, <br />and CITY OF SAN LEANDRO, a municipal corporation, party of the <br />second part, <br />WITNESSETH: <br />Party of the first part does hereby GRANT to party of the second part, <br />a right-of-way and easement for the purpose of permitting water to <br />flow and drain from "PARCEL 1" as said parcel is shown on "PARCEL MAP <br />NO. 983, CITY OF SAN LEANDRO", etc., filed November 2, 1972, in Book <br />76 of Parcel Maps, at page 50, Alameda County Records, over, along <br />and across a portion of "PARCEL 2" as the last said parcel is shown <br />on said Parcel Map, and percolate in and on that certain real property <br />of the party of the first part described as follows: <br />REAL PROPERTY in the City of San Leandro, County of Alameda, State of <br />California,described as follows: <br />ALL OF "PARCEL 2" as said parcel is shown on said PARCEL MAP NO. 983, <br />CITY OF SAN LEANDRO", etc., <br />EXCEPTING from said "PARCEL 2" hereinabove described the following <br />described parcel of land; ' <br />BEGINNING at the Southeastern corner of that 31.698 acre parcel of <br />land designated as "PARCEL 2", and delineated on said "PARCEL MAP NO. <br />983, CITY OF SAN LEANDRO", etc.; running thence along the Southeastern <br />line of said parcel, South 58' 52' 05" West 635.756 feet to the inter- <br />section thereof with the direct extension produced Southeasterly of <br />that course and distance designated on said parcel map as "N. 26' 15' <br />13" W. 336.756 (feet)"; thence Northwesterly along the last said <br />direct extension produced Southeasterly and along said designated <br />course and distance, North 26° 15' 13" West 917.724 feet to the general <br />Northern line of said "PARCEL 2"; thence Northeasterly and South- <br />easterly along the last named line the following six courses and <br />distances to the point of beginning: North 54' 13' 45" East 198.804 <br />feet; North 62° 24' 02" East 8.621 feet; along the arc of a tangent <br />curve to the right with a radius of 367.245 feet, through an angle of <br />73' 43' 32", for a distance of 472.554 feet; South 43' 52' 27", East <br />65.000 feet; along the arc of a tangent curve to the right, with a <br />radius of 367.245 feet, through an angle of 0° 45' 40", for a distance <br />of 4.878 feet; and South 31' 07' 55" East 576.236 feet to the point <br />of beginning;• <br />AND CONTAINING (excluding excepted area) an area of 19.713 acres, <br />more or less. <br />As a condition of this easement, party of the first part shall construct <br />upon the excepted portion of "PARCEL 2" hereinabove described, in, over, <br />under, along, or across the excepted portion of "PARCEL 2", hereinabove <br />described, suitable drainage facilities and/or drainage ditch or citches <br />having sufficient capacity and length to adequately drain the water <br />away from the aforesaid "PARCEL 1". <br />
