4.. GRANT OF EASEMENT This Indenture made this day of f 19730 between JERAS CORPORATION, a corporation, party of the first part, and CITY OF SAN LEANDRO, a municipal corporation, party of the second part, WITNESSETH: Party of the first part does hereby GRANT to party of the second part, a right-of-way and easement for the purpose of permitting water to flow and drain from "PARCEL 1" as said parcel is shown on "PARCEL MAP NO. 983, CITY OF SAN LEANDRO", etc., filed November 2, 1972, in Book 76 of Parcel Maps, at page 50, Alameda County Records, over, along and across a portion of "PARCEL 2" as the last said parcel is shown on said Parcel Map, and percolate in and on that certain real property of the party of the first part described as follows: REAL PROPERTY in the City of San Leandro, County of Alameda, State of California,described as follows: ALL OF "PARCEL 2" as said parcel is shown on said PARCEL MAP NO. 983, CITY OF SAN LEANDRO", etc., EXCEPTING from said "PARCEL 2" hereinabove described the following described parcel of land; ' BEGINNING at the Southeastern corner of that 31.698 acre parcel of land designated as "PARCEL 2", and delineated on said "PARCEL MAP NO. 983, CITY OF SAN LEANDRO", etc.; running thence along the Southeastern line of said parcel, South 58' 52' 05" West 635.756 feet to the inter- section thereof with the direct extension produced Southeasterly of that course and distance designated on said parcel map as "N. 26' 15' 13" W. 336.756 (feet)"; thence Northwesterly along the last said direct extension produced Southeasterly and along said designated course and distance, North 26° 15' 13" West 917.724 feet to the general Northern line of said "PARCEL 2"; thence Northeasterly and South- easterly along the last named line the following six courses and distances to the point of beginning: North 54' 13' 45" East 198.804 feet; North 62° 24' 02" East 8.621 feet; along the arc of a tangent curve to the right with a radius of 367.245 feet, through an angle of 73' 43' 32", for a distance of 472.554 feet; South 43' 52' 27", East 65.000 feet; along the arc of a tangent curve to the right, with a radius of 367.245 feet, through an angle of 0° 45' 40", for a distance of 4.878 feet; and South 31' 07' 55" East 576.236 feet to the point of beginning;• AND CONTAINING (excluding excepted area) an area of 19.713 acres, more or less. As a condition of this easement, party of the first part shall construct upon the excepted portion of "PARCEL 2" hereinabove described, in, over, under, along, or across the excepted portion of "PARCEL 2", hereinabove described, suitable drainage facilities and/or drainage ditch or citches having sufficient capacity and length to adequately drain the water away from the aforesaid "PARCEL 1".
