IN THE BOARD OF DIRECTORS <br />1 OF THE <br />HAYWARD AREA RECREATION A14D PARK DISTRICT <br />RESOLUTION NO. R-1314-53 <br />RESOLUTION OF THE BOARD OF DIRECTORS OF THE HAYWARD <br />AREA RECREATIO14 AND PARK DISTRICT DECLARING TERRITORY <br />KNOWN AS HESPERIAN BOULEVARD ANNEXATION UNIT 90 BE <br />WITHDRAWN FROM THE HAYWARD AREA RECREATION AND PARK <br />DISTRICT <br />WHEREAS, the Local Agency Formation Commission of Alameda County, <br />on March 22, 1973, by Resolution No. 73-5, approved the annexation_ of <br />HESPERIAN BOULEVARD ANNEXATION UNIT 90 to the City of San Leandro, and <br />WHEREAS, the HESPERIAN BOULEVARD ANNEXATION UNIT 90, an area of <br />approximately 16 acres, is located on Hesperian Boulevard between Olive <br />Court and Highway 580, and <br />WHEREAS, the Local Agency Formation Commission of Alameda County, <br />approved the annexation subject to the condition that the area be detached <br />from the Hayward Area Recreation and Park District, and <br />WHEREAS, Section 56034 of the State of California Public Resources <br />Code and Section 56291 of the State of California Government Code provides <br />that "a district whose boundaries would be changed as a result of a proposed <br />annexation, detachment or minor boundary change shall be the conducting <br />district and proceedings for such annexation, detachment or minor boundary <br />change shall be taken by the board of directors of such district." <br />NOW, THEREFORE, BE IT RESOLVED, that the Board of Directors of <br />the Hayward Area Recreation and Dark District hereby determines to withdraw <br />from said District all of that territory in the County of Alameda, State of <br />California, described in "Exhibit A" attached hereto and made a part hereof. <br />BE IT FURTHER RESOLVED, that the boundaries of the Hayward Area <br />Recreation and Park District are hereby altered and the territory described <br />in "Exhibit A" attached hereto and made a part hereof be withdrawn from the <br />Hayward Area Recreation and Park District. <br />DATED: S 2 n ll?.J11 k r 11, 1913 <br />INTRODUCED BYs /nOP61300 <br />AYES: Actl'jl, Gras , morroson <br />NOES: CAMP" <br />ABSTAIN: k(7bDIM <br />ATTEST: <br />KENNETH C.
