1970 <br />IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br />RESOLUTION NO. 73 - 43 <br />RESOLUTION OF APPLICATION <br />(Detachment of Annexed Territory - Hesperian <br />Properties - from HARD) <br />Recitals <br />By Ordinance No. 70-46 adopted October 19, 1970, the City Council of <br />the City of San Leandro approved the annexation of Hesperian Boulevard Properties <br />between Castro Valley Freeway and the Western Pacific Railroad, Unit 90. <br />Said territory is described in Exhibit A attached hereto and incorporated <br />herein by reference. <br />Pursuant to Government Code Section 35317, a certified copy of said <br />ordinance was filed in the office of the Secretary of State on October 30, 1970. <br />Pursuant to Government Code Sections 34080 and 34081, an affidavit of <br />completion, a certified copy of the boundary description and a map delineating <br />the boundary, together with the certificate of the Secretary of State was <br />filed with the Recorder of Alameda County on December 16, 1970. <br />The above -described territory is uninhabited under the provisions of the <br />Annexation of Uninhabited Territory Act of 1939. <br />The owners of said properties wish to have them detached from the Hayward <br />Area Recreation and Park District. <br />NOW, THEREFORE, the City Council of the City of San Leandro does RESOLVE <br />as follows: <br />That, pursuant to Title 6, Division I of the Government Code, the City <br />Council of the City of San Leandro proposes that the above -described properties <br />within the City of San Leandro be detached from the Hayward Area Recreation <br />and Park District so that the owners thereof will not be taxed for duplicate <br />services and requests that the Local Agency Formation Commission of Alameda <br />County initiate proceedings for the change of organization proposed herein, <br />and it is further <br />RESOLVED, that the City Clerk shall file a certified copy of this reso- <br />lution with the executive officer of the Local Agency Formation Commission. <br />
