1970 IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO RESOLUTION NO. 73 - 43 RESOLUTION OF APPLICATION (Detachment of Annexed Territory - Hesperian Properties - from HARD) Recitals By Ordinance No. 70-46 adopted October 19, 1970, the City Council of the City of San Leandro approved the annexation of Hesperian Boulevard Properties between Castro Valley Freeway and the Western Pacific Railroad, Unit 90. Said territory is described in Exhibit A attached hereto and incorporated herein by reference. Pursuant to Government Code Section 35317, a certified copy of said ordinance was filed in the office of the Secretary of State on October 30, 1970. Pursuant to Government Code Sections 34080 and 34081, an affidavit of completion, a certified copy of the boundary description and a map delineating the boundary, together with the certificate of the Secretary of State was filed with the Recorder of Alameda County on December 16, 1970. The above -described territory is uninhabited under the provisions of the Annexation of Uninhabited Territory Act of 1939. The owners of said properties wish to have them detached from the Hayward Area Recreation and Park District. NOW, THEREFORE, the City Council of the City of San Leandro does RESOLVE as follows: That, pursuant to Title 6, Division I of the Government Code, the City Council of the City of San Leandro proposes that the above -described properties within the City of San Leandro be detached from the Hayward Area Recreation and Park District so that the owners thereof will not be taxed for duplicate services and requests that the Local Agency Formation Commission of Alameda County initiate proceedings for the change of organization proposed herein, and it is further RESOLVED, that the City Clerk shall file a certified copy of this reso- lution with the executive officer of the Local Agency Formation Commission.
