1095 <br />IN THE vJTY COUNCIL OF THE CITY Or SAN- LLA:iDRO <br />RESOLUTION NO. 70 - 274 <br />RESOLUTION WITHDRAWING AN14EXED TERRITORY FROM <br />ASHLAND COUNTY FIRE PROTECTION DISTRICT <br />(Hesperian Boulevard Properties) <br />Recitals <br />By Ordinance No. 70-6 adopted October 19, 1970, the City Council of the <br />City of San Leandro approved the annexation of Hesperian Boulevard Properties <br />between the Castro Valley Freeway and the Western Pacific Railroad, Unit <br />No. 90. Said territory is described in Exhibit A attached hereto and incor- <br />porated herein by reference. <br />Pursuant to Government Code Section 35317, a certified copy of said <br />ordinance was filed in the office of the Secretary of State on October 30, <br />1970. <br />Pursuant to Government Code Sections 34080 and 34081, an affidavit of <br />completion, a certified copy of the boundary description and a map delineating <br />to boundary, together with the certificate of the Secretary of State was <br />filed with the Recorder of Alameda County on December 16, 1970. <br />NOW, THEREFORE, the City Council of the City of San Leandro does RESOLVE <br />as follows: <br />That, pursuant to Health and Safety Code Section 13952, the herein de- <br />scribed Hesperian Boulevard Properties are hereby withdrawn from the Ashland <br />County Fire Protection District, effective this date. <br />Introduced by Councilman Kant and passed and adopted this <br />21st day of December, 1970, by the follo:.-ing called vote: <br />Members of the Council: <br />Ayes: Councilmen Coppa, Kant, Nahm, Polvorosa, Pomares, Suer•stedt; <br />Mayor Pia 1 tes ter ( 7 <br />Noes: None <br />Absent: None <br />The foregoing Resolution No. 7"19 - W / * ( 0 <br />is a true And correct copyea4 a Resol ion passed,this <br />day , 19 - ( N <br />by <br />H. <br />Attest:t / _1� <br />Richard H.
