1095 <br />IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br />RESOLUTION NO. 70 - 274 <br />RESOLUTION WITHDRAWING ANNEXED TERRITORY FROM <br />ASHLAND COUNTY FIRE PROTECTION DISTRICT <br />(Hesperian Boulevard Properties) <br />Recitals <br />By Ordinance No. 70-46 adopted October 19, 1970, the City Council of the <br />City of San Leandro approved the annexation of Hesperian Boulevard Properties <br />between the Castro Valley Freeway and the Western Pacific Railroad, Unit <br />No. 90. Said territory is described in Exhibit A attached hereto and incor- <br />porated herein by reference. <br />Pursuant to Government Code Section 35317, a certified copy of said <br />ordinance was filed in the office of the Secretary of State on October 30, <br />1970. <br />Pursuant to Government Code Sections 34080 and 34081, an affidavit of 'U / <br />completion, a certified copy of the boundary description and a map delineating <br />the boundary, together with the certificate of the Secretary of State was <br />filed with the Recorder of Alameda County on December 16, 1970. <br />NOW, THEREFORE, the City Council of the City of San Leandro does RESOLVE <br />as follows: <br />That, pursuant to Health and Safety Code Section 13952, the herein de- <br />scribed Hesperian Boulevard Properties are hereby withdrawn from the Ashland <br />County Fire Protection District, effective this date. / <br />Introduced by Councilman Kant and passed and adopted thisVr <br />21st day of December, 1970, by the following called vote: <br />Members of the Council: <br />Ayes: Councilmen Coppa, Kant, Nahm, Polvorosa, Pomares, Suerstedt; <br />Mayor Maltester ( 7 ) <br />Noes: None <br />Absent: None <br />Attest: <br />( 0 ) <br />( 0 ) <br />Jack D.
