1095 <br />IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br />ORDINANCE NO. 70 - 46 <br />AN ORDINANCE ANNEXING TO THE CITY OF SAN LEANDRO <br />HESPERIAN BOULEVARD PROPERTIES BETWEEN THE CASTRO <br />VALLEY FREEWAY AND THE WESTERN PACIFIC RAILROAD, <br />UNIT NO. 90 <br />Recitals <br />The City Council of the City of San Leandro on August 24, 1970, on <br />its own motion, adopted Resolution No. 70-2C9 and thereby duly and regularly <br />initiated proceedings to annex the hereinafter described territory. <br />Said territory consists of uninhabited territory as defined by the <br />Annexation of Uninhabited Territory Act of 1939. <br />Prior to the passage of the above -mentioned resolution, the proposal <br />for the annexation of said property was submitted to and reported upon by <br />the Local Agency Formation Commission in compliance with the provisions of the <br />Government Code relating to the alteration of boundaries. <br />Frocee.P ngs have been duly and properly held in compliance with the <br />Annexation of Uninhabited Territory Act of 1939. <br />This Council has previously determined by resolution that no majority <br />protest to the proposed annexation has been made. <br />NOW, THEREFORE, the City Council of the City of San Leandro does ORDAIN <br />as follows: <br />Section 1. Annexation of Hesperian Boulevard Properties between the <br />Castro Valley Freeway and the Western Pacific Railroad, Unit No. 90 is <br />hereby approved. <br />Section 2. The City Clerk is hereby directed to prepare under seal of <br />this City and transmit to the Secretary of State a certified copy of this <br />ordinance and upon receipt of a certificate of filing, to file with the <br />Recorder of the County of Alameda an affidavit of completion as required by <br />law. <br />Section 3. The boundaries of the territory annexed are specifically <br />described as follows: <br />
