AGREEMENT <br />This Agreement, made and entered into by and between the City of. <br />San Leandro, a municipal corporation, hereinafter called the "City," <br />and Ugo Abram and A. J. Mendonca, hereinafter called the "Owners:'' <br />Whereas, the Owners are desirous of having certain uninhabited <br />territory owned by them and located in Eden Township, Alameda County, <br />California, a particular description of which said property is marked <br />"Exhibit A," attached hereto and by this reference incorporated herein, <br />annexed to said City and to receive the benefits and services rendered <br />by such City; and <br />Whereas, such annexation may take some time to complete; and <br />Whereas, the Owners are desirous of receiving the services of the <br />City and benefits of being annexed to and becoming a part of the City <br />at the earliest possible date: <br />Now, therefore, the parties agree as follows: <br />That in consideration of the premises and of the promises on the <br />part of the Owners hereinafter contained the City grants to the Owners <br />a personal license (not running with the land) to immediately connect <br />their plants to the sewer line of the City and the City further agrees <br />to extend to the Owners all municipal services that can be legally <br />rendered, including but not limited to fire protection and domestic <br />and industrial sewage services as fully as though said land was <br />actually within the corporate limits of the City. <br />The Owners promise and agree that if through any reason said an- <br />nexation is not completed the Owners will pay to the City at the time <br />hereinafter set forth an annual service charge for the foregoing <br />municipal services, which charge shall be equal to all real and <br />personal property taxes upon all the property of the Owners, were it <br />located in the City, for all municipal purposes including its pro rata <br />share of all existing outstanding bonded indebtedness of the City of <br />San Leandro and of any future bonded indebtedness that may be voted <br />while this Agreement is in effect. Said service charge shall <br />commence July 1, 1964, and continue thereafter until said service <br />charge is replaced by taxes upon said property through and after <br />
