�r r AGREEMENT This Agreement, made and entered into by and between the City of San Leandro, a municipal corporation, hereinafter called the City, and Dallman Supply Company, hereinafter called the Company - Whereas, the Company is desirous of having certain jai-t-ed territory owned by it and located on Davis Street near Doolittle Drive and surrounded by the City of San Leandro, a particular description of which said property is marked "Exhibit A," attached hereto and by this reference incorporated herein, annexed to said City and to receive the benefits and services rendered by such City; and Whereas, such annexation may take some time to complete; and Whereas, the Company is desirous of receiving the services of the City and benefits of being annexed to and becoming a part of the City at the earliest possible date: Now, therefore, the parties agree as follows That in consideration of the premises and of the promises on the part of the Company hereinafter contained the City grants to the Com- pany a personal license (not running with the land) to immediately connect its plant to the sewer line of the City and the City further agrees to extend to the Company all municipal services that can be legally rendered, including but not limited to fire protection and domestic and industrial sewage services as fully as though said land was actually within the corporate limits of the City. The `'gmpany promises and agrees that if through ary reason said annexation is not completed the Company will pay to the City at the time hereinafter set forth an annual service charge for the foregoing municipal services, which charge shall be equal to all real and personal property taxes upon all the property of the Company, were it located in the City, for all municipal purposes including its pro rats of all existing outstanding bonded indebtedness of the City of San Le- andro and of any future bonded indebtedness that may be voted while
