�r <br />r <br />AGREEMENT <br />This Agreement, made and entered into by and between the City of <br />San Leandro, a municipal corporation, hereinafter called the City, and <br />Dallman Supply Company, hereinafter called the Company - <br />Whereas, the Company is desirous of having certain jai-t-ed <br />territory owned by it and located on Davis Street near Doolittle Drive <br />and surrounded by the City of San Leandro, a particular description of <br />which said property is marked "Exhibit A," attached hereto and by this <br />reference incorporated herein, annexed to said City and to receive the <br />benefits and services rendered by such City; and <br />Whereas, such annexation may take some time to complete; and <br />Whereas, the Company is desirous of receiving the services of the <br />City and benefits of being annexed to and becoming a part of the City <br />at the earliest possible date: <br />Now, therefore, the parties agree as follows <br />That in consideration of the premises and of the promises on the <br />part of the Company hereinafter contained the City grants to the Com- <br />pany a personal license (not running with the land) to immediately <br />connect its plant to the sewer line of the City and the City further <br />agrees to extend to the Company all municipal services that can be <br />legally rendered, including but not limited to fire protection and <br />domestic and industrial sewage services as fully as though said land <br />was actually within the corporate limits of the City. <br />The `'gmpany promises and agrees that if through ary reason said <br />annexation is not completed the Company will pay to the City at the <br />time hereinafter set forth an annual service charge for the foregoing <br />municipal services, which charge shall be equal to all real and <br />personal property taxes upon all the property of the Company, were it <br />located in the City, for all municipal purposes including its pro rats <br />of all existing outstanding bonded indebtedness of the City of San Le- <br />andro and of any future bonded indebtedness that may be voted while <br />
