Carden City Attorney - <br />SUBJECT Re: Annexation of Eden Road - Your memo 8/4/61 -- Our No. C-1944 <br />1 Just prior to March 8 1961, 1 carefully reviewed the files on the above annexation. On <br />2 that date the Cif Manager, the Public Works Director, and I discussed the matter at length. <br />3 My notes show that the following were outlined: <br />4 (a) Pelkey and Rich requested the Public Works Director to take necessary steps for <br />5 annexation of certain properties not described to the City of San Leandro. Since these <br />6 requests were not used within six months of their date they are now void. <br />7 (b) Prior to that time I had prepared a petition for the annexation of the entire area <br />8 in question This petition has disappeared I have, therefore, prepared new Rapers covering <br />9 the annexation These include a request for detachment of the same territory from the City of <br />10 Oakland and the consent of the freeholders to such detachment This consent must be signed by <br />11 at least two-thirds of the freeholders within the territory holding at leastwo-thirds in <br />12 value of the real property in the territory. <br />13 A petition for annexation has also been prepared which should be signed by the owners of <br />14 not less than one fourth of the area of the land in such territory repres nt i nq not less than <br />15 one-fourth of the assessed value of such territory according to the last preceding_equalized <br />16 assessment roll of Alameda County in whirh siirh territory is situated ThP sinnaturPs nf al1 <br />17 nwners that it is nnssihle to nhtain should be obtained <br />18 After these papers are signed they should not be filed until all concerned have had a con- <br />19 ference And a schedule of timing has been worked out <br />20 The City of Oakland (not the Port of Oakland) is the real party in interest and negotia- <br />21 tions should be had with the City Council or its staff to ascertain whether or not the City of <br />22 Oakland will agree; otherwise, all effort spent in this long prolonged matter has been a <br />23 complete waste of time and energy. <br />24 -- <br />qlj-ld-I aA2�i� �7- ( ?-�U 4& 4 <br />Arthur M.
