Carden, City Attorney <br />SUBJECT EDEN ROAD ANNEXATION <br />1 Althouah I have had nothina to do with neqotiations pertaininq to the annexation of the <br />2 Eden Road properties for more than ten years last past, I have been continuously bombarded with <br />3 questions as to the status of this proposed annexation. <br />4 1 have. this morning, carefully reviewed the files thereon. I find that in 1958 both <br />5 Pelkev and Rich-reauested the Public Works Director to take the necessary steps for the annexa- <br />6 tion of certain properties, not described, to the City of San Leandro. Since these requests <br />7 are more than six months old they are now void insofar as operating as a petition for the <br />8 annexation of the properties mentioned. <br />9 1 have prepared a petition for the annexation of the entire area. This petition must be <br />10 signed by the owners of not less than one-fourth of the area of the land in such territory, <br />11 representing not less than one-fourth of the assessed value of such territory according to the <br />12 last prer_edingequalized assessment roll of Alameda County in which such territory is situated. <br />13 The signatures of those representing the ownership of more than one-fourth should be obtained <br />14 i- n+ .11—cc;kI- <br />15 1 have also spared a request for detachment of the same territory from the City of <br />16 Oakland and consent of freeholders to such detachment. This consent must be signed by at least <br />17 two-thirds of the freeholders within the territory holding at least two-thirds in value of the <br />18 real property in the territory. <br />19 After thesepetitinns Are siqned they should not be filed until all concerned have a <br />20 conference and work out a schedule of timing; however, such petitions will become v(bid if not <br />21 filed within six months from their date. <br />22 <br />Arthur M.
