City Manager Harry Rosenberg March 17, 1961 <br />City Attorney's Office <br />Annexation of Port property now in San Leandro. <br />You have referred to me the February 2, 1961, letter <br />of San Leandro City Manager Wesley McClure relative to a proposed <br />exchange of property. The proposal is for San Leandro to detach <br />some 13 acres of Port of Oakland owned property now within San <br />Leandro so that it can be annexed to the City of Oakland and for the <br />City of Oakland to detach some 7 acres of privately owned property <br />on Eden Road so that it can be annexed by San Leandro. <br />The desired results can be obtained by proceedings <br />under the "Annexation of Uninhabited Territory Act of 1939" as <br />to the Fort of Oakland owned property and probably as to privately <br />owned property on Yden Road. Certain steps will have to be <br />taken and certain documents will have to be prepared and as the <br />McClure letter does not indicate how much of this has been done, <br />1 am writing you at this time in order to clarify our position. <br />In order for the City of San Leandro to annex the <br />privately owned property, our City Council must have received <br />the written consent to detachment of at least 2/3 of the freeholders <br />within the territory holding at least 2/3 in value of the real property <br />within the territory; and then the City Council by resolution must <br />consent to the detachment. Consequently, will you arrange to <br />obtain a determination of the value of the privately owned property <br />on Eden Road and the written consent of at least 2/3 of the free- <br />holders holding at least 2/3 of that value for presentation to the <br />Council. <br />As to the Port owned property, weshall have to obtain <br />a resolution from the San -Leandro City Council consenting to its <br />detachment from San Leandro and for that purpose I assume that <br />San. Leandro will wish a consent from the Board of fort Commis- <br />sioners. However, that latter is not our immediate concern. <br />
