Honorable City Council <br />October 4, 1963 <br />2. The "consents" of the owners of Parcels 1 <br />and 2 have been obtained and have been furnished to the <br />respective cities of San Leandro and Oakland to authorize <br />them to "de -annex" the respective parcels. <br />3. The City of Oakland has taken the first <br />step to annex Parcel 1 by passing Resolution No. 43621 <br />I C.M.S. on August 27, 1963, declaring its intention to annex <br />the parcel as soon as it can legally be done, and directing <br />the City Clerk to submit the legal description of this <br />parcel to the County Boundary Commission for its review <br />and report. This is a necessary procedural step. The <br />Boundary Commission has reviewed the description and by <br />its September 25 report has approved the description with <br />a minor alteration. This escription, as so modi e has <br />been submitted to the City Engineer and to the Port of <br />Oakland, and has been approved by both of them. <br />4. Engineers of the Port of Oakland and the <br />City of San Leandro have computed the number of cubic yards <br />of garbage fill which the City of San Leandro is entitled <br />to dump in the future on the Port of Oakland property <br />pursuant to agreement between those bodies. This determines <br />the capacity or volume that the City of San Leandro will be <br />entitled to dump on Scavenger Company property as a sub- <br />stitute for the Port property as a result of the pending <br />agreement between San Leandro, the Port, and the Scavenger <br />Company. <br />5. A meeting was held at the Port of Oakland <br />offices on September 11 for what it was thought would be <br />the final meeting to tie up all loose ends and permit the <br />completion of the various steps to effect the proposed <br />"de -annexation", annexation, and exchange of garbage dump <br />rights to enable the development of the golf course. <br />Present at the meeting were representatives of San Leandro, <br />Port of Oakland, the Scavenger Company, Recreation Com- <br />mission of the City of Oakland, and the writer. During <br />the course of this meeting a San Leandro representative <br />stated that it was the position of San Leandro that the <br />cost and expense of men and equipment involved in disposing <br />of its garbage on the Scavenger Company site would be borne <br />by the City of Oakland or the Port. This condition stated <br />on behalf of San Leandro was an entirely new element in <br />the picture as far as all other parties represented at the <br />meeting were concerned. At the present time under the <br />existing agreement with the Port San Leandro bears the <br />cost of its garbage disposal, including labor and equipment <br />on the Port property.
