The City of Oakland will consent to this <br />annexation by San Leandro, and for this purpose will <br />require the request to de -annex by property owners Pelkey, <br />Rich, Joseph, Blasques and Zeitz. The requests of these <br />property owners could use this description of the total <br />area and refer to their interests In it. <br />3. As to Parcel 3 - The enclosed description <br />states that the real property is "partly in the City of <br />,An Leandro and partly in the City of Oakland." As laid <br />out on the map, however„ it appears to lie entirely within <br />the City of Oakland. Please verify the correctness of this <br />statement in the description, because if the parcel actually <br />doses lie partly in both cities, the description will have <br />to be revised so as to set forth only the area within the <br />City of Oakland, so that that description could then be <br />used .for the purposes: (a) Of the consent by the City <br />Council to its cue -annexation; and (b) By the City of San <br />Leandro in its resolution to annex. Perhaps the description <br />can be revised solely by deleting the words "partly in the <br />City of San Leandro and partly% <br />Property owner Holmes should request the City of <br />Oakland to consent to the de -annexation and should use the <br />correct description in his request. <br />It appears that the following procedural ateps <br />are indicated with reference to theses several parcels <br />1. As to Parcel 1 - the City of Oakland will <br />pass a resolution of its intention to initiate action to <br />a.n_nex this parcel as soon as it can legally do so. I pro- <br />pose to present this resolution to the City Council Tuesday, <br />August 20, 1963. For this first step the legal description <br />must be agreed upon. <br />2. A Letter would go to the Boundary Commission <br />again using; this agreed description and request the Boundary <br />commission to review the proposed annexation. <br />3. The requests from the Port of Oakland and <br />from the Southern Pacific Railroad to de -annex should go <br />to the City of San Leandro. <br />4. The resolution of the City of :San Leandro <br />consenting; to the annexation by the City of Oakland of this <br />property. <br />-2- <br />
