IN THE CITY CODICIL OF' THE JCITY OF SAN LEANDRO <br />RESOLUTION NO. ./C.M.S. <br />RESOLUTION FINDING THAT PROTEST IS NOT MADE BY <br />THE OWNERS OF ONE-HALF OF THE VALUE OF PROPERTY <br />OF THE TERRITORY PROPOSED TO BE ATNEXED <br />(Mulford Gardens) <br />Whereas, by Resolution No. 3145 C.M.S., the City Council of the City <br />of San Leandro declared its intention to call a special election to be <br />held on the fourteenth day of May, 1957, in certain inhabited territory con-, <br />tiguous to said City proposed to be annexed to said City, for the purpose <br />1-1 of submitting to the qualified electors residing in said territory the <br />questi.,n whether or not said territory shall be annexed to said City; and <br />and <br />Whereas, a copy of said resolution was published as required by law; <br />Whereas, at a time not later than the hour set for hearing objections <br />to the proposed election, a petition purporting to be a protest against the <br />proposed election was filed with the Clerk.. No supplemental protests against <br />the election were filed within ten (10) days after the time set for hearing <br />objections to the election, or at all; and <br />Whereas, at the time to which the hearing of protests against said <br />election was continued, the City Council proceeded to hear the same .and <br />now finds <br />1. That the purported protest for objection is not in the form re- <br />quized by law therefor, does not give the information required by law, <br />and is not, therefore, a legal protest; that nevertheless such purported <br />protest was made by the owners, the aggregate value of whose territory, <br />as defined by law as shown by the last equalized a-stt,ssment roll amounts <br />to Ninety-two Thousand, Five Hundred Fifty and No/1.00 Dollars ($92,550.00); <br />that the aggregate value of the territory, as defined by law, of the terri- <br />tory proposed to be annexed, to -wit, Mulford Gardens, a=; shown by the last <br />equalized assessment roll is Eight Hundred Ninety-eight Thousand, '11re:e <br />Hundred Ninety and No/100 Dollars ($898,390.00).
