OUTLINE OF ANNEXATION PROCEEDINGS <br />Inhabited Territory <br />I. Proponents of annexation shall submit a proposal therefor to the Boundary <br />Commission of Alameda County, which shall report thereon, within twenty <br />days. <br />At the same time, proponents should request consent of the City Council <br />to annex. Such request must be referred to the Planning Commission and <br />acted upon by the Council after report and recommendation from the Plan- <br />ning Commission. <br />Proponents of annexation shall publish a notice of intention to circulate <br />petition, containing names of proponents intending to circulate such peti- <br />tion and specific boundaries of territory proposed to be annexed, <br />a. Notice may be accompanied by printed statement, not exceeding <br />500 words in length, of reasons for proposed petition, <br />be Within ten days of publication date of said notice, the pro- <br />ponents shall file a copy of the notice, accompanying statement, <br />and an affidavit of the publishing or posting thereof, with the <br />City Clerk. <br />c, Within fifteen (15) days after such filing, City Council may ac- <br />knowledge, by resolution, receipt of notice and approve circulation <br />of petition. <br />d. Twenty-one days after the publication or posting thereof, the pe- <br />tition may be circulated among voters of area proposed to be <br />annexed for the submission of signatures, <br />ee Petition favoring annexation shall be signed by not less than <br />one-fourth of the qualified electors residing within territory <br />described, as shown by registration of voters in the county, in <br />which territory is situated, <br />f. Petitions relating to annexation of territory by a municipal cor- <br />poration must indicate date of each signature thereon. No such <br />petition is valid for purpose for which circulated after six months <br />from date of first signature affixed. <br />II. Legislative body of municipal corporation receiving a written petition <br />therefor must without delay pass a resolution of intention to call a <br />special election giving at least 50 days notice thereof and submit to the <br />electors residing in territory proposed by such petition to be annexed to <br />municipality the question whether such territory shall be annexed to the mun- <br />icipal corporations <br />a. Resolution shall name an hour, day, and place where any person <br />owning real property in annexed territory may appear before legis- <br />lative body and show cause why such territory should not be annexed. <br />Hearings shall be not less than fifteen nor more than forty days <br />from passage of said resolution. <br />bo Any property owner in the territory to be annexed may make written <br />protest against proposed election. If owners of one-half of the <br />:slue of the territory proposed to be annexed protest, no further <br />proceedings shall be had, <br />e. If majority of such owners do not protest, legislative body of city <br />must without delay call a special election in territory to be an- <br />nexed and submit the question whether it shall be annexed to the city. <br />III. If a favorable vote is cast, municipal corporation's legislative body can <br />pass by ordinance an approval of annexation, <br />
