ADMINISTRATION BUILDING OAK STREET • OAKLAND, CALIFORNIA 94614 . ..d-0844 <br />October 28, 1965 <br />co , <br />Mr. Glen Forbes, City Attorney CITY <br />City of San Leandro <br />City Hall <br />San Leandro, California <br />Dear Mr. Forbes: <br />By its Resolution No. 113633, the Alameda County Board of Supervisors <br />filed a notice of intention to annex two sections of the Nimitz Freeway <br />to the City of San Leandro, and designated this proposal as the "Nimitz <br />Freeway Annexation to the City of San Leandro. In reviewing this pro- <br />posal, the Local Agency Formation Commission held a public hearing on <br />October 18, 1965. At the hearing, the Commission expressed the view that <br />the area in this proposal should logically be part of the City of San <br />Leandro and the annexation should be approved. <br />One problem with regard to the annexation did occur. At the time of the <br />submission of the proposal it was assumed that this was all tax exempt <br />land and that therefore there would be no question of adding taxable <br />assessed value to the rolls of the City of San Leandro. In analyzing the <br />proposal, two things were discovered: <br />1. That there was, indeed, on the State assessed utility <br />roll an assessed value of property owned by two utility <br />companies, assessed at $31,400. <br />2. That $27,800 of the State assessed valuation was contained <br />within the current boundaries of the Ashland County Fire <br />Protection District, which has a current tax rate of 86 <br />cents. <br />The Commission believed that it would be inappropriate to annex this area <br />to the City of San Leandro and leave it within the Ashland County Fire <br />Protection District, feeling that this would result in a double taxation <br />situation. Therefore, it was the Commission's view that there should be <br />some assurance that the area annexed to the City be detached from the <br />Ashland County Fire Protection District at substantially the same time as <br />the City annexation was completed. <br />There are two methods which occurred to the Commission by which the <br />"exclusion" of territory from the fire protection district could be ac- <br />complished: <br />
