referred to as approximately 83,000 cubic yards, shall be pre- <br />cisely determined by actual cross -sections taken at the time of <br />the execution of this agreement or at some other date mutually <br />agreeable to all parties hereto. When the actual amount thereof <br />is ascertained it shall be made a matter of record and a copy <br />thereof furnished to all parties hereto. <br />5. Paragraph 4 of that certain Agreement and Conveyance <br />dated the 31st day of October, 1960s by and between the Port and <br />San Leandro is hereby amended to read as follows: <br />"4. If at any time after March 1, 1961, <br />and during the existence of the easement <br />granted hereby, the Port shall pay any real <br />property taxes to the County of Alameda or <br />San Leandro, or both, assessed upon any real <br />property now owned by the Port and located <br />within the boundaries of San Leandro, or upon <br />that certain real property located within <br />the existing approach zone to Runway 11/29 at <br />Metropolitan Oakland International Airport <br />presently owned by Trojan Powder Company, a <br />corporation, located in the City of San Leandro, <br />County of Alameda, State of California, and <br />particularly described as follows: <br />Commencing at an angle point on <br />the easterly side of that Grant to <br />the City of Oakland by the State of <br />California, Chapter 1028, Statutes <br />of 1955, said point is indicated as <br />'Station 3' on the 'Map of the Grant <br />to the City of Oakland, Chapter 10280 <br />Statutes of 1955, Vic' nity of Oakland, <br />Alameda County, California's filed <br />October 25, 1956, in Book of Maps of <br />Alameda County in Book 40, page 76. <br />Said point, indicated as 'Station 3' <br />on the above mentioned map, has the <br />coordinates of y = 438,603.74, <br />x = 1,508,359.53 based on the Cali- <br />fornia Coordinate System, Zone III, <br />as are all distances, bearings and <br />coordinates in this description. <br />Thence North 63° 21' 15" East, <br />301.60 feet to an angle point on <br />the outer boundary of the tide lots <br />as delineated on 'Sale Map No. 1 of <br />Salt Marsh and Tidelands situate in <br />the County of Alameda, State of <br />California', and delineated in the <br />field notes thereof, all on file in <br />the Office of the Department of <br />Finance, State Lands Commission, <br />-5- <br />
