<br />RESOLUTION GIVING NOTICE OF
<br />j PROPOSED ANNEXATION
<br />WHEREAS, it appears :to this
<br />, Council that it would be to the
<br />advantage of this city and the in-
<br />habitants thereof and of future
<br />inhabitants of the Crabb and Ellis
<br />properties hereinafter more parti-
<br />cularly described, that said prop-
<br />erty be annexed to this city, ' and
<br />j this Council desires to annex said
<br />nro yerty by reason of the fact
<br />that said property i•s about to be
<br />',subdivided into attractive home -
<br />sites, requiring municipal ser-
<br />vices: and
<br />WHEREAS, this Council has
<br />j beepi requested to institute an-
<br />; nexation proceedings on its own
<br />'inotion rather than upon written
<br />neti.tion, because of changes like-
<br />ly soon '-to be effected in the title
<br />Ito said property; and
<br />WHEREAS, said property is un-
<br />inhabited;
<br />NOW THEREFORE, the City
<br />Council of the City of San Lean-
<br />dro do resglve ,as follows:
<br />That notice is hereby given
<br />that it is proposed to annex to
<br />tne, City of .San Leandro the here-
<br />inafter described property, which
<br />may be and is hereby designated,
<br />for identification, as the portion
<br />of the Crabb and Ellis Tract
<br />west of. the proposed East Shore
<br />Highway situated on the north-
<br />erly side, of Davis Street west
<br />of - ;the Westerly city limits, as
<br />they now exist.
<br />That notice is .hereby further '
<br />given that at 8:00 p. in. on Mon-
<br />day, January 24, f944 in the Coun-
<br />cil Chambers of the City Hall,
<br />San Leandro, California any per-
<br />son owning real property within
<br />the boundaries of the hereinafter
<br />described, territory so -proposed to
<br />be annexed and having any ob-
<br />jections to ;the proposed annexa-
<br />tion may appear before this City
<br />Council and show cause why such
<br />territory should not be annexed.
<br />That at any time not later than
<br />the hour set for hearing objections.
<br />to the proposed annexation, any:
<br />owner of property within the ter-
<br />ritory proposed to be annexed may
<br />file written protest against the
<br />proposed annexation. Such protest
<br />shall state the name or names
<br />of -the owner or owners of the
<br />property affected thereby and the
<br />description and area of such
<br />property in general terms.
<br />That this .Council does hereby
<br />declare that these annexation pro-
<br />ceedings have been initiated by it
<br />for the reasons set forth in the
<br />preamble hereof.
<br />That the City Clerk is hereby
<br />directed to cause a copy of this
<br />resolution to be published at least
<br />once a week for two successive
<br />weeks prior to the above men-
<br />tioned hearing .in ,the San Leandro
<br />News -Observer, a newspaper of
<br />general 'circulation published in
<br />this city.
<br />That the boundaries of the ter-
<br />ritory hereinabovd.-proposedto be'
<br />annexed are specifically described
<br />as fellows:

<br />said lot is shown on that cer-
<br />tain map entitled, "Tract 590,
<br />,San Leandro, Alameda -County,

<br />female citizen of the United States, over the age of 21 years and neither
<br />party to nor in any way interested in the matter or action herein set forth,

<br />County of Alameda, State of California, and as such, has now and at all

<br />paper; that said SAN LEANDRO NEW o was at all times herein
<br />mentioned a newspaper of general circ lation as that term is defined by
<br />Section 4460 of the Political Code, and as provided by said Section, is
<br />published for the dissemination of local and telegraphic news and intell-
<br />igence of general character, having a bona fide subscription list of paying
<br />subscribers, and is not devoted to the interests or published for the
<br />entertainment or instruction of a particular class, profession, trade, call-
<br />ing, race or denomination, or for any number of such classes, pro-
<br />fessions, trades, callings, races or denominations; that at all said times
<br />said newspaper has been established, printed and published at regular
<br />intervals, in said City, Township, County and State, for more than a year
<br />preceding the date of the first publication of the notice herein mentioned;
<br />that said notice was set in type not smaller than nonpariel, and was pre-
<br />ceded with words in blackface type not smaller than nonpariel, describing
<br />and expressing in general terms the purport and character of the notice
<br />intended to be given.
