<br />ORDINANCE APPROVING AN-
<br />NEXATION OF THE WESTERLY
<br />PORTION OF THE DONOVAN 70
<br />ACRES, THE CHARLES HALE
<br />17.42 ACRE BRACT. AND THE
<br />ELLIS 20.SS ACRE TRACT.
<br />WHEREAS this Council on May
<br />18th 1942 passed its resolution No.
<br />47.4, C. M. S. and thereby duly
<br />and regularly initiated proceedings
<br />to annex the hereinafter described
<br />terranry on its own motion; and
<br />WHEREAS, said resolution speci-
<br />fically described the boundaries
<br />of the territory so proposed to be
<br />annexed to this city; designated
<br />such territory by an appropriate
<br />Identification; contained a notice
<br />of the place, hour and day, more
<br />than 15 days and lesh than 40
<br />days thereafter, when and where
<br />any person owning real property
<br />within such territory so proposed
<br />to be annexed and having objec-
<br />tions to the proposed annexation
<br />might appetr before this Council
<br />snl show cause why such terri-
<br />tory should not be so annexed:
<br />declared that such proceedings
<br />have been initiated by this Coun-
<br />cil: an'i set forth in addit'on this
<br />Council's reasons for desiring to
<br />annex such territory: and

<br />of said resolution to be published
<br />once a week for two successive
<br />weeks prior to the hearing, to -wit:
<br />on May 22, May 29. and June 3,
<br />1942, in a newspaper of general
<br />eirculation in this City, to -wit:

<br />WHEREAS, the hour set in said
<br />resolutions for hearing objections
<br />to the proposed annexation, to_ wit:
<br />the hour of 8:15 P. M., Monday,
<br />June 15. 1942, has arrived and no
<br />owner of property within the terri-
<br />tory proposed to be annexed or
<br />any person whatever has filed
<br />written or other protest against
<br />the proposed annexation, at the
<br />mare set forth ;n »aid resolution,
<br />to -wit: th^. Council Chambers of
<br />the City Hall, San Leandro, Cali-
<br />fornia, or at any other place
<br />known to this Council, and no pro-
<br />tests have been made to this
<br />Cn+.ncil for hearing at this time:

<br />WHEREAS, this Council there-
<br />fore finds that protest is not made
<br />by the owner or owners of any
<br />property within the territory pro-
<br />posed to hp annexed:

<br />Council of the City of San Lean-
<br />dro do ordain as follows:
<br />Section L The annexation of
<br />the westerly portion of the Dono-
<br />van 70 acres, the Charles Hale
<br />17.42 acre tract and the Ellis 20.88
<br />.ere tract herein referred to, is
<br />hereby approved.
<br />Section 2. The City Clerk is
<br />'-ereby instructed to make, under
<br />the seal of this City, and transmit
<br />t'+ the Secretary of State. a cer-
<br />tified copy of this ordinance, and
<br />n comply with the Affidavit of
<br />completion Law, whereupon the
<br />territory herein referred to shall
<br />he, to all Intents and purposes,
<br />part of this City, except only
<br />that, as provided by law, no
<br />,r *nerty within such annexed ter-
<br />ritory shall ever be taxed to pay
<br />any portion of any indebtedness
<br />or liability of this City contracted
<br />prior to or existing at the time
<br />of such annexation.
<br />Section 3. This ordinance shall
<br />be published once in the News -
<br />Observer.
<br />Section 4. The boundaries of the
<br />territory herein annexed are spec-
<br />ifically described as follows:
<br />All that uninhabited real prop-
<br />erty commencing at the intersec-
<br />tion of the northwesterly line of
<br />Davis Street, also known as
<br />County Road No. 1434 and the
<br />westerly boundary of the City of
<br />San Leandro as said boundary

<br />Section 5. A new section to be
<br />known as Section 5 is hereby
<br />added to Title VII, Chapter 2 of
<br />the San Leandro Municipal Code,
<br />to read as follows:
<br />"7-2-5. On July 6th, 1942, by
<br />Ordinance No. 624 N. S. the west-
<br />erly portion of the Donovan 70
<br />acres, the Charles Hale 17.42 acre
<br />tract and the Ellis 20.88 acre tract,
<br />situated on Davis Street just west
<br />of the westerly city limits was
<br />annexed to this City."
<br />Section 6. This ordinance is
<br />hereby declared to be an urgency
<br />measure passed for the immediate
<br />preservation of the public safety.
<br />The facts constituting the urgency
<br />are as follows: The Federal Hous-
<br />'ng Administration has declared
<br />that the immediate construction of
<br />homes in this vicinity to house de-
<br />fense workers is vital to the na-
<br />tion's safety. Such homes will be
<br />built in the above territory as
<br />soon as they are financed, but
<br />cannot be financed until a map
<br />of said territory is filed. It can-
<br />not be filed until this ordinance
<br />takes effect. Therefore it is ur-
<br />gent that this ordinance take ef-
<br />fect at once to preserve the pub-
<br />lic safety.
<br />Introduced on the 15th day of
<br />June, 1942. by Councilman Knick
<br />and passed and adopted this 6th
<br />day of July, 1942 by the following
<br />called vote:
