<br />RESOLUTION NO. 520 C. M. S.
<br />RESOLUTION GIVING NOTICE
<br />OF PROPOSED ANNEXATION
<br />WHEREAS, it appears to this
<br />Council that it would be to the
<br />advantage of this city and the in-
<br />habitants thereof and of the Sull-
<br />ivan property hereinafter more
<br />particularly described that said
<br />property be annexed to this city,
<br />and this Council desires to annex
<br />said property by reason of the
<br />fact that said property is about
<br />to be subdivided into attractive
<br />homesites, requiring municipal
<br />services; and
<br />WHEREAS, this Council has
<br />been requested to institute annex-
<br />ation proceedings on its own mo-
<br />tion rather than upon written pe-
<br />tition, because of changes likely
<br />soon to be effected in the title to
<br />said property; and
<br />WHEREAS, said property is un-
<br />inhabited;
<br />NOW, THEREFORE, the City
<br />Council of the City of San Lean-
<br />dro do resolve as follows:
<br />That notice is hereby given that
<br />it is proposed to annex to the City
<br />of San Leandro, the hereinafter
<br />described property, which may be
<br />and is hereby designated, for
<br />identification, as the easterly 500
<br />feet of the Sullivan Tract situated
<br />on the southerly side of Davis
<br />Street west of the westerly city
<br />limits.
<br />That notice is hereby further
<br />given that at 8:15 P. M. on Mon-
<br />day, November 16, 1942 in the
<br />Council Chambers of the City Hall,
<br />San Leandro, California any per-
<br />son owning real property within
<br />the boundaries of the hereinafter
<br />described territory so proposed to
<br />be annexed and having any ob-
<br />jections to the proposed annexa-
<br />tion may appear before this City
<br />Council and show cause why such
<br />territory should not be so annexed.
<br />That at any time not later than
<br />the hour set for hearing objections
<br />to the proposed annexation, any
<br />owner of property within the ter-
<br />ritory proposed to be annexed may
<br />file written protest against the
<br />proposed annexation. Such protest
<br />shall state the name or names of
<br />the owner or owners of the prop-
<br />erty affected thereby and the de-
<br />scription and area of such proper-
<br />ty in general terms.
<br />That this" Council does hereby
<br />declare that these annexation pro-
<br />ceedings have been initiated by it
<br />for the reasons set forth in the
<br />preamble hereof.

<br />of said Comity, being duly sworn, deposes and says:
<br />That she is and was during the time herein mentioned, a white female
<br />citizen of the United States, over the age of 21 years and neither a party to
<br />nor in any way interested in the matter of the action herein set forth, and is
<br />and was competent to be a witness in said matter or action;
<br />That she is now and at all times herein mentioned was the printer and
<br />publisher of the. SAN LEANDRO REPORTER, which is and was at all the
<br />times herein mentioned a newspaper of general circulation printed and
<br />published weekly in the City of San Leandro, Township of Eden, County of
<br />Alameda, State of California, and as such printer and publisher has now and
<br />at all of said times had charge of all legal notices and advertisements in
<br />said newspaper;, That said SAN LEANDRO REPORTER is now and was
<br />at all times herein mentioned a newspaper of general circulation as that
<br />term is defined by Section 4460 of the Political Code, and as provided by said
<br />Section, is published for the dissemination of local and telegraphic news
<br />and intelligence of a general character, having a bona fide subscription list
<br />of paying subscribers, and is not devoted to the interests or published for
<br />the entertainment or instruction of a particular class, profession, trade,
<br />calling, race or denomination, or for any number of such classes, professions,
<br />trades, callings, races or denominations; that at all of said times said news-
<br />paper has been established, printed and published at regular intervals in
<br />said City, Township, County and State, for more than one year preceding
<br />the date of the first publication of the notice herein mentioned; that said
<br />notice was set in type not smaller than nonpareil, and was preceded with
<br />words printed in black -face type not smaller than nonpareil, describing and
<br />expressing in general terms the purport and character of the notice intended
<br />to be given.
