IN THE CITY COUNCIL OF THE
<br />CITY OF SAN LEANDRO
<br />ORDINANCE NO. 634 N. S.
<br />ORDINANCE APPROVING AN-
<br />NEXATION OF THE EAST-
<br />ERLY PORTION OF THE SUL-
<br />LIVAN TRACT.
<br />WHEREAS, this Council on
<br />February 1, 1943 passed its res-
<br />olution No. 533 C. M. S. and there-
<br />by duly and .regularly initiated pro-
<br />ceedings to annex the hereinafter
<br />described territory on its own mo-
<br />tion; and
<br />WHEREAS, said resolution spe-
<br />cifically described the boundaries
<br />of the territory so proposed to be
<br />annexed to this city; designated
<br />such territory by an appropriate
<br />identification; contained a notice
<br />of the place, hour and day, more
<br />than 15 days and less than 40 days
<br />thereafter, when and where any
<br />person owning real property with-
<br />in such territory so proposed to be
<br />annexed and having objections to
<br />the proposed annexation might ap-
<br />pear before this Council and show
<br />cause why such territory should
<br />not be so annexed; declared that
<br />such proceedings have been initi-
<br />ated by this Council; and set forth
<br />in addition this Council's reasons
<br />for desiring to annex such terri-
<br />tory; and
<br />WHEREAS, the City Clerk of
<br />this city duly caused a copy of said
<br />resolution to be published once a
<br />week for two successive weeks pri.
<br />or to the hearing, to -wit: on
<br />February 12, February 19, and
<br />February 26, 1943, in a newspaper
<br />of general circulation in this City,
<br />to -wit: the San Leandro Report-
<br />er; and
<br />WHEREAS, the hour set in said
<br />resolution for hearing objections to
<br />the proposed annexation, to -wit:
<br />the hour of 8:15 P. M., Monday,
<br />March 1, 1943, has arrived and
<br />no owner of property within the
<br />territory proposed to be annexed
<br />or a n y person whatever
<br />has filed written or other pro-
<br />test against the proposed annexa-
<br />tion, at the place set forth in said
<br />resolution, to -wit: the Council
<br />Chambers of the City Hall, San
<br />Leandro, California, or at any
<br />other place known to this Council,
<br />and no protests have been made
<br />to this Council for hearing at this
<br />time; and
<br />WHEREAS, this Council there-
<br />fore finds that protest is not made
<br />by the owner or owners of any
<br />property within the territory pro-
<br />posed to be annexed;
<br />NOW, THEREFORE, the City
<br />Council of the City of San Lean-
<br />dro do ordain as follows:
<br />Section 1. The annexation of
<br />the easterly 500 feet of the Sul-
<br />livan Tract, situated on the
<br />southerly side of Davis Street west
<br />of the westerly city limits and
<br />herein referred to, is hereby ap-
<br />proved.
<br />Section 2. The- City Clerk in
<br />hereby instructed to make, under
<br />the seal of this City, and transmit
<br />to the Secretary of State, a certi-
<br />fied copy of this ordinance, and
<br />to comply with the Affidavit of
<br />Completion Laws, whereupon the
<br />territory herein referred to shall
<br />be, to all intents and purposes, a
<br />part of this City, except only that,
<br />as provided by law, no property
<br />within such annexed territory shall
<br />ever be taxed to pay any portion
<br />of any indebtedness or liability of
<br />this City contracted prior to or
<br />existing at the time of such annex-
<br />ation.
<br />Section 3. This ordinance shall
<br />be published once in the San Le-
<br />andro Reporter.
<br />Sction 4. The boundaries of the
<br />territory herein annexed are spe-
<br />cifically described as follows:
<br />All that uninhabited real
<br />property beginning at the
<br />point of intersection of the
<br />Southeastern line of Davis
<br />Street, also known as County
<br />Road No. 1434, with the
<br />Northeastern boundary line of
<br />that certain 65 acre parcel of
<br />land designated as Parcel "A",
<br />in that certain Deed of Gift
<br />from Elizabeth A. Sullivan, a
<br />single woman, to Catherine
<br />C. Sullivan, a single woman,
<br />et al., dated February 14, 1935
<br />and recorded April 17, 1942 in
<br />Liber 4229 of Official Records
<br />of Alameda County, page 89;
<br />running thence South 69° 15'
<br />West along the said line of
<br />Davis Street 500.00 feet;
<br />thence South 23° 00' East and
<br />parallel with the said North-
<br />eastern boundary line 1647.36
<br />feet to a point on the South-
<br />eastern boundary line of the
<br />said 65 acre parcel of land;
<br />thence North 69° 15, East al-
<br />ong the said last mentioned
<br />line 500.00 feet to the most
<br />Eastern corner thereof; thence
<br />North 23° 00' West along the
<br />said Northeastern boundary
<br />line 1647.36 feet to the point
<br />of beginning.
<br />.Said territory may also be spe-
<br />cifically described as follows:
<br />Beginning at the same point
<br />of beginning; running thence
<br />South 69° 30' West along said
<br />line of Davis Street, 500.00
<br />feet; thence South 22° 5T East
<br />and parallel with the North-
<br />eastern boundary line 1646.59
<br />feet to a point on the South-
<br />eastern boundary line of the
<br />said 55 acre parcel of land
<br />thence North 69' 30' East al-
<br />ong the last mentioned line
<br />500.00 feet to the most east-
<br />ern corner thereof; thence
<br />North 22° 57' West along the
<br />said Northeastern boundary
<br />line 1646.59 feet to the point
<br />of beginning.
<br />Section 5. A new section to be
<br />known as Section 6 is hereby
<br />added to Title VII, Chapter 2 of
<br />the San Leandro Municipal Code,
<br />to read as follows:
<br />"7-2-6. On March 15, 1943 by
<br />Ordinance No, 634 N. S. the east-
<br />erly 500 feet of the Sullivan Tract
<br />on the southerly side of Davis
<br />Street just west of the westerly
<br />city limits was annexed to this
<br />city."
<br />Section 6. This ordinance is
<br />hereby declared to be an urgency
<br />measure passed for the immedi-
<br />ate preservation of the public
<br />safety. The facts constituting the
<br />urgency are as follows: The Fed-
<br />eral Housing Administration has
<br />declared that the immediate con-
<br />struction of homes in this vicinity
<br />to house war workers is vital to
<br />the nation's safety. Such homes
<br />will be built in the above territory
<br />as soon as they are financed, but
<br />cannot be financed until a map of
<br />said territory is —filed. It -cannot
<br />be filed until this ordinance takes
<br />effect. Therefore, it is urgent
<br />that this ordinance take effect at
<br />once to preserve the public safety.
<br />Introduced on the 1st day of
<br />March, 1943 by Councilman Thom-
<br />as and passed and adopted this
<br />15th day of March 1943 by the
<br />following called vote:
