IN THE �j ]C COUNCIL OF THE CIT'I; 8AN LEANDRO ORDI IE NO. 653 N. S. ORDINANCE APPROVING AN- NEXATION OF THE WESTER- LY PORTION OF THE SUL- LiVAN T1tACT. WHEREAS, this Council on January 3, 1944 passed its reso- lution No. 615 C. M. S. and there- by duly and regularly initiated proceedings to annex the herein- after described territory on its own motion; and WHEREAS, said resolution specifically described the bound- aries of -the territory so proposed to be annexed to this city; de- signated such territory by an ap- propriate identification; contained a notice of the place, hour and day, more than 15 days and less than 40 days thereafter, when and where any person owning reel property within such territory so proposed to be annexed and hav- ing objections to the proposed an- nexation might appear before this Council and show cause why such territory should not be so an- nexed; declared that such pro- ceedings have been initiated by this Council; and set forth in ad- dition this Council's reasons for desiring to annex such territory; and WHEREAS, the City Clerk of this city duly caused a copy of said resolution to be published once a week for two successive weeks prior to the hearing to wit: on January 7, January 14 and January 21, 1944, in a newspaper of general circulation in this City, to wit: The San Leandro Newa- Observer; and WHEREAS, the hour set in said resolution for hearing objections to the proposed annexation, to wit: The hour of 8:00 p. in., Mon- day, January 24, 1944, has arrived and no owner of property within the territory proposed to be an- nexed or any person whatever has filed written or other protest against the proposed annexation, at the place set forth in said reso- lution, to wit, the Council Cham- bers of the City Hall, San Lean- dro, California, or at any other place known to this Council, and no protests have been made to this Council for hearing at this time; and WHEREAS, this Council there- fore finds that Protest is not made by the owner or owners of any property within the territory pro- posed to be annexed: NOW THEREFORE, the City Council of the City of San Lean- dro do ordain as follows: Rection 1. The }idaries of the territory herein nexed are specifically described as follows: BEGINNING at the point of intersection of the southern boundary line of Davis Street, County Road No. 1434, (said line being the southerly boundary line of the City of San Lean- dro as established by Ordinance No. 624 N. S.,) with the west- erly line of that certain 65 acre, more or less, parcel of land designated as parcel "A" in that certain Deed of Gift from Eliza- beth A. Sullivan, a single woman, to Catherine C. Sullivan, a single women, et al., dated Feb- ruary 14, 1935 and recorded April 17, 1942 in Liber 4229 of Official Records of Alameda County, page 39; running thence southeasterly along said south- western boundary line of said 66 acre parcel of land to the southwestern corner of said par- cel; thence northeasterly along the southern boundary of said 65 acre parcel of land, north 69° 30, east 979.18 feet• more or less; thence north 39° 14' 02" west 1737.11 feet, more or less, to the point of intersection with said southern boundary line of Davis Street County Road No. 1434, (which said southern line of Davis Street is also the exist- ing boundary line of the City of San Leandro as established by . Ordinance No. 624 N. S.); thence southwesterly along said south- eastern line of Davis Street and said City Boundary line south 69° 30, west 185.33 feet more or less, to the point of beginning. BEING a western portion of that certain 65 acre -parcel of land first hereinabove referred to. Section b. A new section to be known as Section 7 is hereby add- ed to Title VII, Chapter 2 of the San Leandro Municipal Code, to read as follows: "7-2-7. On January 31, 1944 by Ordinance No. 653 N. S. That por- tion of the Sullivan Tract on the southerly side of Davis Street just west of the westerly city limits and the proposed East Shore Highway was annexed to this city." Section 6. This ordinance is hereby declared to be an urgency measure passed for the immediate preservation of the public safety. The facts constituting the urgency are as follows: The Federal Hous- ing Administration has declared that the Immediate construction of homes in this vicinity to house war workers is vital to the na- tion's safety. Such homes will be built in the above territory as soon as they are financed, but cannot be financed until a map of said territory Is filed. It can- not be filed until this ordinance takes effect. Therefore, it is ur- gent that this ordinance take ef- fect at once to preserve the public safety.
