<br />ORDINANCE APPROVING AN-
<br />NEXATION OF THE WESTER-
<br />LY PORTION OF THE SUL-
<br />LiVAN T1tACT.
<br />WHEREAS, this Council on
<br />January 3, 1944 passed its reso-
<br />lution No. 615 C. M. S. and there-
<br />by duly and regularly initiated
<br />proceedings to annex the herein-
<br />after described territory on its
<br />own motion; and
<br />WHEREAS, said resolution
<br />specifically described the bound-
<br />aries of -the territory so proposed
<br />to be annexed to this city; de-
<br />signated such territory by an ap-
<br />propriate identification; contained
<br />a notice of the place, hour and
<br />day, more than 15 days and less
<br />than 40 days thereafter, when
<br />and where any person owning reel
<br />property within such territory so
<br />proposed to be annexed and hav-
<br />ing objections to the proposed an-
<br />nexation might appear before this
<br />Council and show cause why such
<br />territory should not be so an-
<br />nexed; declared that such pro-
<br />ceedings have been initiated by
<br />this Council; and set forth in ad-
<br />dition this Council's reasons for
<br />desiring to annex such territory;
<br />and
<br />WHEREAS, the City Clerk of
<br />this city duly caused a copy of
<br />said resolution to be published
<br />once a week for two successive
<br />weeks prior to the hearing to wit:
<br />on January 7, January 14 and
<br />January 21, 1944, in a newspaper
<br />of general circulation in this City,
<br />to wit: The San Leandro Newa-
<br />Observer; and
<br />WHEREAS, the hour set in said
<br />resolution for hearing objections
<br />to the proposed annexation, to
<br />wit: The hour of 8:00 p. in., Mon-
<br />day, January 24, 1944, has arrived
<br />and no owner of property within
<br />the territory proposed to be an-
<br />nexed or any person whatever has
<br />filed written or other protest
<br />against the proposed annexation,
<br />at the place set forth in said reso-
<br />lution, to wit, the Council Cham-
<br />bers of the City Hall, San Lean-
<br />dro, California, or at any other
<br />place known to this Council, and
<br />no protests have been made to
<br />this Council for hearing at this
<br />time; and
<br />WHEREAS, this Council there-
<br />fore finds that Protest is not made
<br />by the owner or owners of any
<br />property within the territory pro-
<br />posed to be annexed:
<br />NOW THEREFORE, the City
<br />Council of the City of San Lean-
<br />dro do ordain as follows:
<br />Rection 1. The annexation of
<br />tl t portion of the Sullivan Tract
<br />west of the proposed East Shore
<br />T1.1g.iway, situated on the south -
<br />side of Davis Street west of
<br />westerly city limits as they
<br />exist and herein referred to,
<br />,reby approved.
<br />ction 2. The City Clerk is
<br />instructed to make, under
<br />sl of this City, and transmit
<br />Secretary of State, a certi-
<br />s' copy of this ordinance, and
<br />niply with the Affidavit of
<br />,tion Law, whereupon the,

<br />Section It. This ordinance shall
<br />published once in the San

<br />Section 4. The }idaries of
<br />the territory herein nexed are
<br />specifically described as follows:
<br />BEGINNING at the point of
<br />intersection of the southern
<br />boundary line of Davis Street,
<br />County Road No. 1434, (said line
<br />being the southerly boundary
<br />line of the City of San Lean-
<br />dro as established by Ordinance
<br />No. 624 N. S.,) with the west-
<br />erly line of that certain 65 acre,
<br />more or less, parcel of land
<br />designated as parcel "A" in that
<br />certain Deed of Gift from Eliza-
<br />beth A. Sullivan, a single woman,
<br />to Catherine C. Sullivan, a
<br />single women, et al., dated Feb-
<br />ruary 14, 1935 and recorded
<br />April 17, 1942 in Liber 4229 of
<br />Official Records of Alameda
<br />County, page 39; running thence
<br />southeasterly along said south-
<br />western boundary line of said
<br />66 acre parcel of land to the
<br />southwestern corner of said par-
<br />cel; thence northeasterly along
<br />the southern boundary of said
<br />65 acre parcel of land, north
<br />69° 30, east 979.18 feet• more or
<br />less; thence north 39° 14' 02"
<br />west 1737.11 feet, more or less,
<br />to the point of intersection with
<br />said southern boundary line of
<br />Davis Street County Road No.
<br />1434, (which said southern line
<br />of Davis Street is also the exist-
<br />ing boundary line of the City of
<br />San Leandro as established by .
<br />Ordinance No. 624 N. S.); thence
<br />southwesterly along said south-
<br />eastern line of Davis Street and
<br />said City Boundary line south
<br />69° 30, west 185.33 feet more or
<br />less, to the point of beginning.
<br />BEING a western portion of
<br />that certain 65 acre -parcel of
<br />land first hereinabove referred
<br />to.
<br />Section b. A new section to be
<br />known as Section 7 is hereby add-
<br />ed to Title VII, Chapter 2 of the
<br />San Leandro Municipal Code, to
<br />read as follows:
<br />"7-2-7. On January 31, 1944 by
<br />Ordinance No. 653 N. S. That por-
<br />tion of the Sullivan Tract on the
<br />southerly side of Davis Street
<br />just west of the westerly city
<br />limits and the proposed East
<br />Shore Highway was annexed to
<br />this city."
<br />Section 6. This ordinance is
<br />hereby declared to be an urgency
<br />measure passed for the immediate
<br />preservation of the public safety.
<br />The facts constituting the urgency
<br />are as follows: The Federal Hous-
<br />ing Administration has declared
<br />that the Immediate construction
<br />of homes in this vicinity to house
<br />war workers is vital to the na-
<br />tion's safety. Such homes will be
<br />built in the above territory as
<br />soon as they are financed, but
<br />cannot be financed until a map
<br />of said territory Is filed. It can-
<br />not be filed until this ordinance
<br />takes effect. Therefore, it is ur-
<br />gent that this ordinance take ef-
<br />fect at once to preserve the public
<br />safety.
<br />Introduced on the 24th day of
<br />January, 1944, by Councilman
<br />Thomas and passed and adopted
<br />this Slat day of January, 1944, by
<br />the following called vote:
