<br />RESOLUTION GIVING NOTICE OF
<br />PROPOSED ANNEXATION'
<br />WHEREAS, it appears to this
<br />Council that it would be 'to the
<br />advantage of this city and the
<br />inhabitants thereof and of future
<br />inhn,bitants .of the Sullivan prop-
<br />er•ty hereinafter more particularly
<br />described that said property be
<br />annexed .fo ithls city, and this
<br />Council desires to annex said prop-
<br />erty by reason_ of the fact that
<br />said property Is•-iibout Ro be sub-
<br />divided into attractive homesites,
<br />requiring municipal services; and
<br />WHEREAS, this Council has
<br />been requested to .institute an-
<br />nexation proceedings on its own
<br />motion rather than upon written
<br />petition, because of changes likely
<br />Soon to he effected in the title to
<br />sald property; and
<br />WHEREAS, said property is un-
<br />inhabiited:
<br />NOW THEREFORE. the City
<br />Council of the City of San Lean-
<br />dro do resolve as follows:
<br />That notice is hereby given that
<br />it Is proposed to annex, to the
<br />City of San Leandro the herein-
<br />after described property, which
<br />may be and is hereby designated,
<br />for identification. as the portion j
<br />of the .Sullivan Tract. west of the +
<br />proposed East Shore Highway - slt-
<br />uahed' on ,the @outherly side of
<br />Davis Street west of the westerly
<br />city limits, as they now exist.
<br />That notice ;is hereby further 1
<br />given_ that at :8:00 p. m. on xibn-
<br />day, January 24, 1944, in the Coun-
<br />ei1..Citambers of-the.

<br />Leandro, California, any person
<br />owning real ;prQpe ty - within the
<br />boundaries of .the hereinafter de-
<br />scribed terrlt ry- so' prppBgAd to be'
<br />annexed and " having any objec-
<br />tions to the proposed annexation
<br />may appear before this City Coun;
<br />ell and show cause why such ter-
<br />ritory should not be so annexed.
<br />That at any time not later than,l
<br />the hour set for hearing objections
<br />to the proposed annexation, any.
<br />owner .of property within the ter-
<br />ritory proposed to be annexed may
<br />fide written protest.. against the
<br />Proposed annexation... Such- protest
<br />shall state the name or names of
<br />the owner or owners of the prop-
<br />erty affected thereby and the de-
<br />scription and area of such prop-
<br />erty in general terms.
<br />That this Council does hereby.
<br />declare that :these annexation pro-
<br />ceedings have been initiated by
<br />it for the reasons :set forth in the
<br />j preamble hereof.
<br />i That the City Clerk is hereby
<br />directed to cause a copy of this
<br />resolution to be published at least
<br />once a week for two successive
<br />weeks prior to the above men-
<br />tioned hearing in the San Leandro
<br />News -Observer, a newspaper of,
<br />general circulation published in
<br />this city.
<br />That the boundaries of the ter-
<br />ritory hereinabove proposed to be
<br />annexed are specifically described
<br />as follows:

<br />more or less, parcel of land
<br />designated as parcel "A" in that
<br />certain Deed of Gift from Eliza-
<br />beth A. Sullivan, a single wo-
<br />man, to Catherine C. Sullivan, a
<br />single woman, at &I., dated Febm
<br />ruary 14, 1935 and recorded April
<br />17, 1942 in Liber 4229,of Official
<br />Affidavit of Publication of

<br />of said County, being duly sworn, deposes and says:
<br />That she is and was during all the time herein mentioned, a white
<br />female citizen of the United States, over the age of 21 years and neither
<br />party to nor in any Way interested in the matter or action herein set forth,
<br />and is and was competent to be a witness in said matter or action.

<br />published semi -weekly in the City of San Leandro, Township of Eden,
<br />County of Alameda, State of California, and as such, has now and at all
<br />said times had charge of all legal notices ve ements in said news-
<br />paper; that said SAN LEANDRO NEW$ s at all times herein
<br />mentioned a newspaper of general circu ation as that term is defined by
<br />Section 4460 of the Political Code, and as provided by said Section, is
<br />published for the dissemination of local and 'telegraphic news and Intell-
<br />igence of general character, having a bona fide subscription list of paying
<br />subscribers, and is not devoted to the interests or published for the
<br />entertainment or instruction of a particular class, profession, trade, call-
<br />ing, race or denomination, or for any number of such classes, pro-
<br />fessions, trades, callings, races or denominations; that at all said times
<br />said newspaper has been established, printed and published at regular
<br />intervals, in said City, Township, County and State, for more than a year
<br />preceding the date of the first publication of the notice herein mentioned;
<br />that said notice was set in type not smaller than nonpariel, and was pre-
<br />ceded with words in blackface type not smaller than nonpaxiel, describing
<br />and expressing in general terms the purport and character of the notice
<br />intended to be given.
