IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br /> <br />RESOLUTION NO. 2022- <br /> <br />RESOLUTION OF THE CITY OF SAN LEANDRO CITY COUNCIL TO <br />APPROVE AND AUTHORIZE THE CITY MANAGER TO EXECUTE A LEGAL <br />SERVICES AGREEMENT WITH CASTILLO, MORIARTY, TRAN & ROBINSON <br />THROUGH JUNE 30, 2024 FOR A TOTAL NOT TO EXCEED AMOUNT OF $500,000 <br /> <br />WHEREAS, the City, in accordance with its purchasing provisions, has identified Castillo, <br />Moriarty, Tran & Robinson to provide legal representation associated with tort liability claims and <br />litigation; and <br /> <br />WHEREAS, the City wishes to transfer cases from previous legal representation with <br />Bertrand, Fox, Elliot, Osman & Wenzel (BFEOW), and Allen, Glaessner, Hazelwood & Werth <br />(AGHW) to Castillo, Moriarty, Tran & Robinson (CMTR) to continue supporting existing cases <br />and future litigation; and <br /> <br />WHEREAS, the attorneys at Castillo, Moriarty, Tran & Robinson have provided the City <br />Council and the City’s administration with excellent service representing the City of San Leandro <br />in tort liability and litigation; and <br /> <br />WHEREAS, Risk Management has sufficient funds in Fiscal Year 2022-2023 account <br />689-19-004-5110 for legal services; and <br /> <br />WHEREAS, Castillo, Moriarty, Tran & Robinson has agreed to the terms of the contract <br />pending Council approval; and <br /> <br />WHEREAS the City Council is familiar with the contents of the agreement; and <br /> <br />WHEREAS, the City Manager recommends approval of said agreement. <br /> <br />NOW, THEREFORE, the City of San Leandro City Council does RESOLVE as follows: <br /> <br />That the agreement is approved and execution by the City Manager is hereby authorized. <br /> <br />Introduced by Councilmember _______ and passed and adopted this 21st day of November <br />2022, by the following vote: <br /> <br />Members of the Council: <br /> <br />AYES: <br /> <br />NOES: <br /> <br />ABSENT:
