<br />28 <br /> <br /> <br />Liquidated Damages <br />The following are the proposed liquidated damages that would be incorporated into the Consultant’s <br />agreement if this service option is considered: <br /> <br />Adhering to Collection Schedule, Collection Services & Counting Services <br />If the Consultant fails to meet its collection schedule obligations, provide the collection and counting services <br />as mutually established in the Scope of Work, the City will issue a written warning. If such an incident occurs <br />again, the Consultant will be assessed liquidated damage of <br />$500. Should a similar violation occur again during the contract term, the Consultant will be assessed <br />liquidated damages without the benefit of warning in the amount of $500 per incident. <br /> <br />Reporting <br />If the Consultant fails to submit any reports identified in the Scope of Work, the City will issue a written <br />warning. If the Consultant fails to remedy the issue within 1 business day from receiving the written <br />warning, the Consultant will be assessed liquidated damages of $50 per day for each day that the report is <br />overdue from the date of the warning. <br /> <br />Broken Locks <br />If the Consultant is responsible for breaking a meter lock, the Consultant will pay for the replacement and <br />installation of the broken equipment. <br /> <br />Open Meter Doors <br />If a meter door is left unsecured as a result of the Consultant Collection Services, the Consultant will issue a <br />written warning. If such an incident occurs again, the Consultant will be assessed liquidated damage of $100 <br />per incident for each occurrence if there is no loss. If a meter can is missing, the assessment shall be an <br />additional $100 per incident, plus the cost to replace the missing equipment. <br /> <br />Equipment <br />The Consultant will be responsible for the safekeeping of assigned City equipment which will be returned to <br />the City in good condition at the termination of the contract.
