May 20 2008 1:57PM CITY OF SAN LERMDRO E/T <br />RIGHT OF ENTRY <br />510-577-3294 p.2 <br />Date: <br />APN : 080H-1549-001-00 <br />CITY OF SAN LEANDRO U C- L V E D <br />Engineering and Transportation Department _C11YOF Ai,4 lXANDRt <br />835 East 14th Street MAY 2 2 2008 <br />San Leandro, California 94577 <br />irh1C' (o RANS. <br />Permission is hereby granted to the City of San Leandro, hereinafter referred to as <br />CITY," to enter upon our land, APN: 0801-1-1549-001-00, located at 14970 Corvallis <br />Street, San Leandro, California for the purposes of the following: <br />Modify the pedestrian ramp within the City's right of way at the intersection of <br />Corvallis Street and Oberlin Avenue to meet Americans with Disabilities Act <br />requirements <br />Remove and re -install sidewalk adjacent to the ramp <br />C Modify our walkway to match the slope of the ramp <br />Modify our landscaping and irrigation system if needed to accommodate the <br />changes. <br />The rights and privileges hereby granted to CITY herein may, at the option of CITY, be <br />exercised by any authorized agent, contractor, or consultant to the CITY. <br />By acceptance of this Right of Entry, it is expressly understood and agreed by and <br />between the parties that CITY agrees to indemnify and save the undersigned OWNERS <br />harmless against any and all loss, damage, and/or liability that may be suffered or <br />incurred by OWNERS, and against any and all claims, demands, and causes of action that <br />may be brought against OWNERS caused by, or arising out of, or in any way connected <br />with, the use and/or occupancy of said lands of OWNERS, as outlined above, by CITY, <br />its agents, contractors or assigns. CITY further agrees to assume full responsibility for <br />any and all damages caused by CITY'S operation under this Right of Entry, and CITY <br />shall, at its option, either repair or pay for such damages. . <br />It is understood that this permission does not constitute a waiver in any way of any rights <br />of ownership of such land. It is understood that there will be no compensation paid for <br />this permission.
