Box 24055 <br />Oakland, CA 94623 <br />RE: Letter Agreement for Pipe Abandonment <br />n <br />Lexington Boulevard between Pershing Drive and Pontiac Street r <br />Dear Mr. Dodge: <br />This letter will serve as an agreement between the City of San Leandro and East Bay Municipal Utility District (District) for <br />the abandonment of the 4" water main (4" CICL E-22442) shown on the improvement plans prepared by EBMUD for the <br />installation of an 8" PVC pipe on Lexington Boulevard between Pershing Drive and Pontiac Street dated May 21, 1996. The <br />District is proposing to abandon said pipes by capping and leaving them in place. However, the City of San Leandro's policy <br />is to remove any unused pipeline within the City's right-of-way so they will not obstruct future utility projects. The City will <br />allow the subject project to proceed and abandon the pipelines as proposed if the District agrees to the following conditions: <br />1. In the event that the abandoned pipes and appurtenances conflict with a future city street or utility improvement <br />project, and an alternative alignment for the proposed storm drain pipe or other street improvement facility is not <br />feasible from an engineering or economical standpoint, then the District shall reimburse the City for the extra <br />installation costs incurred with the removal of the abandoned facilities. <br />2.
