Box 24055 Oakland, CA 94623 Letter Agreement for Pipe Abandonment ' "T '11. 1_V`0 Morgan Avenue between Evergreen Avenue and Juana .Avenue This letter will serve as an agreement between the City of San Leandro and East Bay Municipal Utility District (District) for the abandonment of the 6" water main (6" CICL E-13944) shown on the improvement plans prepared by EBMUD for the installation of an 8" PVC pipe on Morgan Avenue between Evergreen Avenue and Juana Avenue dated August 10, 2004. The District is proposing to abandon said pipes by capping and leaving them in place. However, the City of San Leandro's policy is to remove any unused pipeline within the City's right-of-way so they will not obstruct future utility projects. The City will allow the subject project to proceed and abandon the pipelines as proposed if the District agrees to the following conditions: In the event that the abandoned pipes and appurtenances conflict with a future city street or utility improvement project, and an alternative alignment for the proposed storm drain pipe or other street improvement facility is not feasible from an engineering or economical standpoint, then the District shall reimburse the City for the extra installation costs incurred with the removal of the abandoned facilities. The District shall maintain a record of the abandoned pipes and appurtenances for future reference.
