APN: 077-0573-029-00 <br />RIGHT OF ENTRY <br />CITY OF SAN LEANDRO <br />Engineering and Transportation Department <br />835 East 14`h Street <br />San Leandro, California 94577 <br />Permission is hereby granted to the City of San Leandro, hereinafter referred to as <br />CITY," to enter upon our land, APN: 077-0573-029-00, located at 2100 Bancroft <br />Avenue, San Leandro, California for the purposes of the following: <br />Modify the pedestrian ramp within the City's right of way to meet Americans <br />with Disabilities Act requirements <br />Modify our walkway, landscaping and irrigation system as needed to <br />accommodate the new ramp height <br />The rights and privileges hereby granted to CITY herein may, at the option of CITY, be <br />exercised by any authorised agent, contractor, or consultant to the CITY. <br />By acceptance of this Right of Entry, it is expressly understood and agreed by and <br />between the parties that CITY agrees to indemnify and save the undersigned OWNERS <br />harmless against any and all loss, damage, and/or liability that may be suffered or <br />incurred by OWNERS, and against any and all claims, demands, and causes of action that <br />may be brought against OWNERS caused by, or arising out of, or in any way connected <br />with, the use and/or occupancy of said lands of OWNERS, as outlined above, by CITY, <br />its agents, contractors or assigns. CITY further agrees to assume full responsibility for <br />any and all damages caused by CITY'S operation under this Right of Entry, and CITY <br />shall, at its option, either repair or pay for such damages. <br />It is understood that this permission does not constitute a waiver in any way of any rights <br />of ownership of such land. It is understood that there will be no compensation paid for <br />this permission.
