Appeals Board shall be comprised of the same members as the Building Board of Appeals. <br />The Building Official shall be an ex officio nonvoting member and act as Secretary. <br />113.6 Fees. <br />A fee as set forth in Chapter 4 of the San Leandro Administrative Code shall be paid to the <br />Building Official whenever a person requests a hearing before the appeals boards provided <br />for in this Section. <br />Exception: No fee shall be required for a hearing requested pursuant to Section 116. <br />SECTION 114 <br />VIOLATIONS AND PENALTIES <br />114.1 Compliance with Code. <br />It shall be unlawful for a person, firm or corporation to erect, construct, enlarge, alter, <br />repair, move, improve, remove, connect, convert, demolish, equip, or perform any other <br />work on any building or structure or portion thereof, or cause the same to be done, <br />contrary to, or in violation of, any of the provisions of this Code. <br />114.2 Violation. <br />It shall be unlawful for any person to own, use, occupy or maintain any building or <br />structure or portion thereof, or cause the same to be done, contrary to, or in violation of, <br />any of the provisions of this Code. <br />114.3 Notice of violation. <br />The Building Official is authorized to serve a notice of violation or order on the property <br />owner for the erection, construction, alteration, extension, repair, moving, removal, <br />demolition or occupancy of a building or structure in violation of the provisions of this <br />Code, or in violation of a permit or certificate issued under the provisions of this Code. <br />Such order shall direct the discontinuance of the illegal action or condition and the <br />abatement of the violation. <br />114.3.1 Service. <br />The notice shall be served upon the record owner, in the manner hereinafter stated, and <br />posted conspicuously on the property. The failure of the Building Official to serve any <br />person required herein to be served shall not invalidate any proceeding hereunder as to <br />any other person duly served or relieve any such person or any duty or obligation imposed <br />on him or her by the provisions of this section.
