Amendment No. 1 to Consulting Services Agreement between 11/9/2022 City of San Leandro and Kimley-Horn and Associates, Inc. for Wicks Blvd & Manor Blvd Signal Upgrade Project Page 1 of 4 AMENDMENT NO. 1 TO CONSULTING SERVICES AGREEMENT BETWEEN THE CITY OF SAN LEANDRO AND KIMLEY-HORN AND ASSOCIATES, INC. FOR WICKS BOULEVARD AND MANOR BOULEVARD SIGNAL UPGRADE PROJECT PROJECT NO. 2020.5620 This Amendment No. 1 (“Amendment”) is made by and between the City of San Leandro (“City”) and Kimley-Horn and Associates, Inc. (“Consultant”) (together sometimes referred to as the “Parties”) as of ____________________________, 2022, and amends that certain Consulting Services Agreement (“Agreement”) dated March 24, 2021, between the Parties. WHEREAS, City and Consultant have executed the Agreement, pursuant to which Consultant has provided certain consulting services to City with regard to design services for the Wicks Boulevard and Manor Boulevard Signal Upgrade Project, and WHEREAS, the Parties desire to amend the Agreement to provide additional design services for curb ramps not part of the original design scope and to reduce the surveying and potholing scope. NOW THEREFORE, for good and valuable consideration, the sufficiency of which is hereby acknowledged, the Parties hereby agree to amend the Agreement as follows: 1. Section 1.1 of the Agreement entitled “Terms of Services” is hereby amended to extend the term from June 30, 2023 to June 30, 2024; and 2. Section 2 of the Agreement entitled “Compensation” is hereby amended to pay Consultant a sum not to exceed EIGHTY-SIX THOUSAND FOUR HUNDRED SEVENTY-THREE DOLLARS AND 28 CENTS ($86,473.28); and 3. Exhibit A of the Agreement entitled “Scope of Services” is hereby amended as follows: The first sentence of the sixth paragraph of Task 3.1 is replaced with the following: Based on the layout of the signal equipment developed in the preliminary design, Kimley-Horn will perform potholing at six (6) proposed pole locations at the project intersection to positively locate existing utilities and aid in the placement of the proposed signal pole locations. The following paragraph is added to the end of Task 3.0: The driveway to the Wicks Business Park on the west side of the project intersection is not ADA-compliant. Consultant shall redesign the driveway / sidewalk at the business park entrance to meet ADA requirements and design new curb ramps at the north and south ends of the driveway. The following paragraph is added to the end of Task 4.0: The final design documents shall include the redesign of the driveway / sidewalk at the entrance to Wicks Business Park and the design of curb ramps at both ends of said driveway.
